ADCs assist in military disciplinary matters such as court martial and Article 15 proceedings, as well as adverse administrative actions such as involuntary discharges, demotions and letters of reprimand or counseling. ADCs can also assist in other areas, such as advising members who have been held financially liable under the report of survey process. ADCs cannot become involved in civilian court matters, nor can they solicit (actively seek) clients. Whether dealing with a court martial. Article 15. administrative discharge or any other adverse action, it is important to contact the ADC as soon as y by Capt. Marc Mayer Area Defense Counsel - - The Area Defense Counsel would like to take this opportuntity to familiarize military members with the critical role they play in the military community. Essentially, the ADC is what is often known as a public defender; that is. a lawyer who advocates on behalf of someone accused of wrongdoing. ADCs. like all military attorneys, are real lawyers. They're licensed to practice law after successfully completing four years of college, three additional years of law school and a rigorous ' "fs he still there, captain?" professional credentialing exam. Military attorneys also undergo training in military law and become certified to practice before military courts. What distinguishes the ADC from other military attorneys is the client who is served. The ADC is to zealously represent the interests of the person accused of wrongdoing, and it is through such representation that our judicial system is best served. Until the early 1970s, lawyers from each base legal office took turns acting as defense counsel. That meant the accused person's defense attorney and the prosecuting attorney worked for the same boss. Among those rights are the rights to say nothing at all and to talk to a lawyer. Invoking these rights doesn't mean a person has anything to hide or that he or she has done anything wrong. It simply means he or she is exercising an option guaranteed to everyone under our system of laws. PETER'S EPISCOPAL CHURCH 1204 Pastor: Dennis Whisler Secretary of Defense directed a reorganization placing all defense counsels under the Judge Advocate General, rather than under the base level staff judge advocate who works for the wing commander. Because of this, the ADC works independently of the or of other lawyers on the base. ADCs are now part of the U.S. Air Force judiciary and report to a senior defense counsel assigned to one of the five worldwide locations. The ADC program is set up this way so clients can be assured that ADCs really work for them and not for the commanders who may have taken action against them. Some people hesitate to contact ADC when faced with trouble for fear that something they say may be used against them. Nothing could be further from the truth. Unlike discussions members may have with the base legal office, commanders, supervisors or friends, anything he or she says to an ADC is strictly confidential and can only be disclosed with the client's permission.
