It is widely understixvl by budding lawyers that the first-year contracts course is designed to separate sepa-rate ttve w.th true aptitude for the law from those of us uho should get on with our lives. Starting this week and continuing off and on throughout the summer. ' our elected and appointed representatives representa-tives will be considering contractual relationships with various Olympic participants. In short, we intend to enter into several short-term l.ind- k'rdlenant relationships as a part of ' our Olympic participation. Those proposals pro-posals raise a number of public policy issues that need to be attended to. but we ought not to do too much hand wnnging over this process. Just because the "Olympic" moniker is attached doesn't mean c are jumping into bed with the dev il or abanekMiing iHir public responsibilities. In reviewing review-ing these deals, it is important to understand mutual objectives, and to create unrealistic expectations the same stuff 1 have been preaching in this column fir many months. The lease tor a portion of the City Taik is first on the agenda. What sorts of public polic issues are raised.' Well, first, as always, we have to deal with the impacts of the proposed use. Our town has grown to the point where most of out events inconvenience inconve-nience someone, make notse. delay traffic, interfere with parking, or oth- ' erwise disrupt our daily routines. The pnvtxiscd use of the Park by SLOC contains lease arrangements that will help plan for and mitigate thise impacts. In addition, your city council has insisted that my office, other city staffers, and SLOC' make the extra effort to ensure that the sponsor h- pitality village built in am junction with our participation in the Olympics is both successful and a gxxl neighbor. In reality, the sponsor village will create fewer park impacts than the holiday celebrations, concerts, various athletic activities, reunions and company com-pany parties that are inflicted on our community park every summer day At Wast during the Olympics, we are going to get paid for it. and any damages dam-ages will be repaired and restored by contract which is more than I can say for anv of our other events. their expenses. The sponsor village will attract several thousand folks who will be investing in Park City for the course of the Games. Many are likely to come back or otherwise invest in our community on a longer-term basis. Finally, the lease is consistent with our Olympic experience. Since the Games are going to be in town anyway, any-way, and since we are all going to be impacted in one way or another, why not go the extra mile and get something some-thing more out of it? fit In reality, the sponsor village will create fewer park impacts than the holiday celebrations, concerts, various athletic activities, reunions and company parties that are inflicted on our community park every summer day. " Frank Bell Next, we have to consider the property itself in conjunction with the proposed uses. Our various axk-s and regulations are pretty lenient with respect to temporary and event uses, so permitting is fairly easy. In the winter, win-ter, it is covered in snow and unused, so the property is available and there will be few impacts to existing programs pro-grams or events Finally, we are protected pro-tected against damages. So. if we are going to protect the neighborhood, and the property is protected and not otherwise being used, the final question considers what is in it for us. First, there is the no-small-sum of S3tXMKtU cash which is better than a poke in the eye with a sharp slick. Doesn't seem like much money? When was the last time we rented anything for S.VXUKS) for a few weeks when it is otherwise unused.' Hie reality is. our relative wealth in publicly-owned publicly-owned space will help balance our Olympic budget which, right now. is increasingly heavy on the expense side. Most other communities in the Olympic theater are not so fortunate and have far fewer options to defray Despite what you might have heard or read, there has been an extensive public process in this leasing leas-ing of public spaces business. The concept is described in detail in our Isws Olvmpic Master Plan and our lN Olympic Financial Plan. Our local media have been covering the proposals for months, so the only secret about any of this is the exchange of considerations and how much. The considerations of any contract are negotiated privately, then opened for public discussion, so at this point SLOC has not been treated differently than anyone else. The remainder of the proposal has been discussed in a variety of public meetings, and has been widely reported. At the end of the day I hope you will trust your representatives to cut the best deal possible, thoroughly consider the public policies at stake, and act responsibly. As with anv political decision, some people may not be happy, or some people may think we could have should have gotten a better deal. Maybe so. maybe not. but the lease of the north end of the park for Olympic purposes purpos-es has more pluses than minuses and, as a community, we will be better off for the deal. In short, the public benefits ben-efits outweigh the public liabilities or impacts a decidedly non-legalistic approach.
