This was the first year the rodeo will be televised to a national audience. ESPN2 will air the broadcast on Aug. 6 and Aug. 11. NAN CHALAT-NOAKER PARK RECORD Background check system in disarray Senate Judiciary Committee Chairman Orrin Hatch, R-L'tah, says that the National Instant Criminal Background Check System (NICS), which is designed to prevent criminals from purchasing firearms, is suffering suf-fering from needless delays partly part-ly due to occasional system failures. fail-ures. Hatch, who chaired a hearing on the NICS system recently, said that some states, such as his Obituaries home state of Utah, can independently indepen-dently conduct background checks more efficiently than the federal government. Hatch is co-sponsoring co-sponsoring legislation that would reimburse states like Utah for conducting their own criminal background checks. He is survived by his wife Carol; three sons: Beau. Broc and Wyatt; two sisters: Bobbie Butters and Sally Wharton; and one grandson. Dylan. He was preceded in death by both parents, son Dylan and brothers Pat and Jo. Family serv ices will be held at the Butters home. 768 Creekside Dr., Lavton. Utah. Sunday. Julv 9. 2000, from 2-4 p.m. Mark "Mutt" Mitchell Mark Mitchell, age 83, passed awav Mondav. Julv 3, 2000, in Francis, Utah.BornSept. 15. 1916 in Hayden, Utah, the son of Dennis Jared and Margaret Atkinson Mitchell. He married Laile McNeil Jan. 30, 1941 in Coalville, Utah. The marriage was later solemnized in the Salt Lake LDS Temple. Mark was foreman of the Myrick Ranch in Marion, Utah for many years. He retired from the Summit County Road Department, where he made many life-long friends. Mark enjoyed the outdoors. He especially liked to fly fish and hunt. He was a loving husband, father and grandfather. His family always came first. He was the best "Void sheep herder that ever lived." Mark is preceded in death by his wife Laile, 1991; daughter Luann; three brothers and three sisters. Survivors include his son Michael D. (Janet) Mitchell of Ft. Briciger. Wyo.; two daughters: Myrtle (Jcrald) Atkinson of Lyman. Wyo.; Myrlene (Douglas) Fowles of Francis; two brothers: Elmer, of Vernal. Utah; Wendell, of Kamas; and two sisters: Delpha, of California; and Edna, of Portland, Ore.; he is also survived by seven grandchildren and 11 great-grandchildren. Funeral services were held Thursday. July 6, 2000. at the Francis ' LDS Ward Chapel. Interment was in the Francis Cemetery. Instead of an instant check, we have a system that too often causes needless delay to law-abiding citizens who are simply exercising their constitutional consti-tutional rights. System outages are a major culprit. When the system is down, neither federal nor state background checks can proceed, and gun sales cannot occur. According to FBI data, system outages amounted to over 2 IS. 5 hours of down-time last year." Testimony at today's hearing indicated that Utah is a state that does a good job of maintaining a database of background information informa-tion and therefore is able to clear sales faster. In Utah, all firearm sales are cleared through the state backgrounding center prior to any transfer from dealer to buyer. Captain Stuart Smith, the bureau chief of the Bureau of Criminal Identification with the Utah Department of Public Safety, testified that Utah transferred trans-ferred more than 90,000 firearms last year, with a denial rate of 2,7 percent. He noted that states have the ability to do a better job of backgrounding persons prior to firearms transfers, but suffer from a lack of funding. To address this concern. Sen. Hatch noted that he is sponsoring legislation with Sen. Patrick Leahy, D-Vermont. to reimburse states such as Utah, that agree to be point-of-contact states for NICS. Full point-of-contact states are those states that agree to conduct con-duct all background searches for firearms purchases rather than relying on the FBI to do so. Smith noted that Utah's ability to access more records at the local level and do it more quickly and more comprehensively keep approval times down while ensuring a quality product. "States have advantages including better access to court records and a better understanding understand-ing of state firearms laws." Hatch noted. "Utah and other states who do such a good job with criminal background checks deserve recognition for their vital role in making NICS a more efficient effi-cient and effective tool."
