Maps, and much more. by AMBER McKEE Record staff writer The Planning Commission is between a rock and a hard place. Or perhaps more accurately, a golf course and a hard place. They voted June 10 to continue action on the proposed Thaynes No. 8 Subdivision, located on the corner of Thaynes Canyon Drive and Morningstar Drive, to further consider the issues involved. The problem is this: Residents of Thaynes Canyon maintain they were told when they purchased homes in the area that the 39,375 square foot parcel would remain open space and a part of the golf course. According to a staff report, when the golf course and Thaynes Canyon Subdivision were developed by Greater Park City Corporation (GPCC), promises were made about the open space status of the golf course. When Park City bought the golf course from GPCC in 1981, the Thaynes No. 8 parcel was taken out of the deal at the last minute, according to Golf Pro Doug Vilvcn. All was forgotten until recently when the land was purchased from GPCC by Thomas Guy, who filed the application for Thaynes No. 8. The controversy is whether or not the Planning Commission can deny a development, which basically conforms to planning standards, based on promises made to the neighboring homeowners by a third party. The city's legal counsel, Jim Carter and Shauna Kerr, have repeatedly said, "No." "That is not necessarily what the Planning Commission looks at," Assistant City Attorney Ken-said Ken-said during the work session June 10. "This isn't really a fact-finding body. It's not the planning process: it's the civil litigation process." One staff report echoed Kerr's sentiments saying, "As far as staff can determine, there never has been a legal restriction on the property." Thaynes Canyon homeowners were not pleased to hear that verdict. "I realize the planning staff is not our adversary in this matter," John Manwearing, of 2368 Morningstar Drive, said. "However, I do take exception to a senior planner saying that it has to be approved. The Planning Commission and city in general can place restrictions if they are done in the name of our health and safety." Planning Commissioner Bruce Erickson pointed out that the commission must deal with the application in a planning rather than legal context. Commissioner Alison Child agreed, saying she had planning concerns with the subdivision. "Lot 1 is a dangerous place to be because of flying golf balls....I've hit that one." Her other concerns included house sizes and height restrictions. Morningstar Drive resident Charlie Layton argued during the meeting that there were legitimate planning grounds on which to deny the project citing the city's subdivision ordinance section 15.1.3 (e), "the purpose of the ordinance is to protect and conserve the value of land throughout the municipality and value of buildings and improvements upon the land, and to minimize the conflicts among the uses of land and buildings." "By obstructing my view, this subdivision will reduce the value of my property by around $30,000-$40,000, $30,000-$40,000, as well as that of others in the area," he said. "When you buy an implied golf course view lot, it should remain a golf course view lot." Layton said he planned to submit a proposal to GPCC stating that they should 1) reimburse Guy for the land; 2) deed the property to the city so that it could be rezoned to recreational open space (ROS) and the fences removed, "so that the property can be returned to what it was intended for," he said, "a golf course." Commissioner Dean Berrett suggested the Planning Commission approve the sketch plat so that the project would move forward to the City Council, who might have more authority to act on behalf of the neighbors. Commissioners Chris Erickson and Ron Whaley agreed and made a motion and a second to approve the sketch plat. However, when it came to the vote, Commissioners Child, Joe Tesch and Chuck Klingenstein were against an approval. Commissioner Bruce Erickson broke the tie, also voting against approval. Another motion was made and the sketch plat was continued until the June 24 meeting, so that the issues of house size, height limits and golf balls could be more closely examined. Berrett voted against the continuance. Park City Historical Society awards ceremony held The Park City Historical Society recognized exceptional historical renovation projects in Park City at a ceremony held May 29 at SL Mary's Catholic Church, located at 1 15 Park Ave. The awards are held every year, according to president Dale Snyder to "recognize all of the real outstanding projects." The society, she said, chooses four or five of those annually, to receive a commemorative plaque. The five plaque winners in this year's Preservation Awards are the following: Park City Municipal (445 Marsac Ave.); Richard and Anne Clegg (575 Park Ave.); Episcopal Church (515 Park Ave.); Jim and Tina Lewis (481 Woodside Ave.); Geneva A. Butkovitch (1100 Woodside Ave.). The society also awarded 35 additional renovation projects in Park City with certificates. "Our hope is to somehow recognize all the people who are doing great renovation projects," Snyder said. She added that many of the plaque recipients have also received grants from the city's Historic Renovation Matching Grant program. The venue for this year's awards ceremony, St. Mary's, was a plaque recipient last year. Amnesty Applications postponed indefinitely The Planning Commission voted June 10 to postpone the Amnesty Applications indefinitely until a resolution to solve the problem of illegal untils in Park City can be found. According to a memorandum from Planning Director Nora Seltenrich and Deputy City Attorney Shauna Kerr, "the staff plans to meet with neighborhood representatives to better understand their concerns and to try to come to a mutally acceptable solution...."
