Containing 19.926 acres. PROPOSED SERVICES. It is proposed pro-posed that the Special Service District be formed in order to provide the following services within the above described boundaries: A. Acquiring culinary water shares from Weber Basin Water Conservancy Conservan-cy District for use by property owners within the District (the "Owners") for irrigation purposes; B. Purchasing untreated irrigation water shares for use by the Owners at such time as the same become available for purchase at reasonable rates; C. Acquiring other water rights; NOTICE OF INTENTION OF THE CENTERVILLE CITY COUNCIL TO ESTABLISH A SPECIAL SERVICE DISTRICT IN THE CHASE LANE ESTATES CASA LOMA SUBDIVISION AREA OF CENTERVILLE CITY PUBLIC NOTICE IS HEREBY GIVEN THAT THE CENTERVILLE CITY COUNCIL HAS ADOPTED A RESOLUTION PROPOSING ESTABLISHMENT ES-TABLISHMENT OF A SPECIAL SERVICE DISTRICT TO BE KNOWN AS THE CHASE LANE ESTATESCASA LOMA SPECIAL SERVICE DISTRICT (REFERRED TO IN THIS NOTICE SIMPLY AS THE PROPOSED DISTRICT). BOUNDARIES. The Proposed District will include that part of Center-ville Center-ville City within those areas of what is commonly known as the following subdivisions:1 sub-divisions:1 "Chase Lane Estates Plat "A", Chase Lane Estates Plat "B", Chase Lane Estates Plat "C", Casa Loma Plat "F", and Chase Lane West Plat 'A" which properties are located in Davis County, State of Utah within a boundary more particularly described as follows: All the area within the following platted subdivisions -Casa Loma Plat "F", Chase Lane Estates ' 'A' Chase Lane Estates "B", and Chase Lane Estates "C", more specifically described below. Beginning at the Northeast corner of Lot 20, Casa Loma Plat " F" subdivision, said point being South 1,353.37 feet from the Northeast comer of the Southeast Quarter of Section Sec-tion 6, T2N, R1E, SLB&M; and running thence South 543. 1 3 feet along the east boundary line of said Casa Loma Plat "F" subdivision to a point on the Northerly boundary boun-dary line of Chase Lane Estates "C" subdivision; thence N 88 degrees 50'E 343.40 feet along said Northerly boundary line to the Northeast corner of Lot 82 of said Chase Lane Estates "C" subdivision; thence South 192.00 feet along the East boundary line of said Lot 82 to the Southeast corner of said Lot 82, said point also being on the Northerly right-of-way line of Powell Avenue; thence S 88 degrees 50'W 368.405 feet to the Northeast corner of Lot 76 of said Chase Lane Estates "C subdivision; thence South 319.764 feet to the point of curvature with a 375 foot radius curve to the right; thence Southerly 39.27 feet along the arc of said curve to the point of tangency; thence S 6 degrees 00'W 222.40 feet to a point on the Northerly right-of-way line of Chase Lane; thence S 89 degrees 56'W 622.871 feet along said Northerly right-of-way line to the Southwest comer of Lot 49, Chase Lane Estates " B " subdivision; D. Financing, constructing or arranging ar-ranging for the construction of a secondary water transportation, distribution and storage system for the benefit of the Owners at such time as irrigation water shares become available for purchase at reasonable rates; E. Raising funds, by way of taxes, assessments or otherwise, for the purpose pur-pose of acquiring said culinary water shares on an ongoing basis and for raising additional capital for purposes of (i) establishing and funding a capital capi-tal account to be used to create a secondary water transportation system to service the District at such tune as untreated irrigation water becomes economically available to the District for use in serving the irrigation ir-rigation water needs of all property lying within the District, (ii) establishing estab-lishing and funding a capital account to acquire irrigation water shares or rights sufficient to service the needs of the District, and (iii) establishing r and funding an administrative account ac-count to cover administrative expenses ex-penses of the District. All such accounts ac-counts and all funds deposited therein shall at all times belong to and be administered ad-ministered by the District for the benefit of the Owners; and F. Entering into such con-tracts con-tracts , instruments and agreements, and undertaking such other activities as may be reasonably necessary to carry out the foregoing and following purposes. SUPERVISION AND CONTROL. The governing body of Centerville City shall have control over the Proposed Pro-posed District if established. The petitioners peti-tioners in this matter have requested the formation of an administrative control board consisting of not less than three not more than five electors residing within the Special Service District and that the administrative control board be delegated with those powers and authority allowed by law. HEARING. A public hearing on the Proposed District will be held on the 11th day of September, 1990 at 7:00 p.m. at the Jennie P. Stewart Elementary School, 1155 North Main Street, Centerville City, Utah. At the hearing, the City Council will hear and consider all interested persons desiring to be heard. PROTESTS. Protests against the establishment of the Proposed District or the furnishing of the above specified types of services within the Proposed District may be made orally at the hearing or in writing during or prior to the hearing or within fifteen (15) days after the conclusion of the hearing, by any interested person. The City Council will give full consideration considera-tion to all protests that have been filed. fil-ed.
