He said he did not rccicve the new code until 10 minutes prior to the meeting and felt it would not be proper to pass the new code without making sure the wording was correct. Any resolution to the wording of the new student code has been postponed until May 22. Al-Qirim also wanted the wording of a proposed amendment on off campus behavior to be clarified. McCleve said that concern was raised over the off campus behavior code to act as a safety net for students who may fall victim of unjust referrals. The resolution is currently worded, "Off-campus behavior by students or student groups may be referred to any interested party to the due process office for review." Al-Qirim would have the wording changed to:"Off-campus behavior by students or students groups acting as an official representative for the institution for utilizing the name of the institution in any capacity may be referred by any interested party." "The purpose of the student code is to protect the rights of the students," Al-Qirim said. "There is a criteria in the code that a complaint must be met before action is taken." McCleve said a behavior that violates the student code and poses an unreasonable risks of harm to the health, safety or welfare of the university community may result in sanctions against a respondent to a complaint. "The criteria is there to prevent unjust action to be taken against a student especially if in incident occurs off campus. If the complaint does not fulfill the criteria, it will not be acted on," he said. McCleve said university community jurisdiction can include students and student organizations off campus. The student code recognizes the jurisdiction of Federal, state and civil authority and when an act violates both criminal and civil laws and university rules, concurrent jurisdiction will apply. Other items that were postponed were: B Resolution 91-21: The Wildcat Shuttle, sponsored by Matt Snyder, Matt Weeks and Ari Hunsaker for the shuttle bus to be provided to students living in the residence hall for home basketball games. The resolution cites the lack of transportation in the winter months makes it difficult for students to get to the games. Resolution 91-20 sponsored by Robert Nelson and Mu-taz Al-Qirim was presented to urge the history department to retain Dr. Susan Baker on the faculty of the history department. A petition was circulated among students urging the department not to let Baker go. B Resolution 91-22, Senate Flags, sponsored by Scott Robinson, Dave Hall, Robert Nelson, Bill Vicars and Matt Weeks to purchase ? n American, Utah State and Weber State flags for the student senate room.
