' PROVO: The case of the State against Heber Clark, appealed from the Justice's court in Pleasant Grove, was tried in the Fourth District court in Provo yesterday. The defendant was charged with assault and battery, committed upon his wife. After the taking of testimony the Judge ordered the Jury to render a verdict of not guilty, which was- done without the Jury leaving the box. The defendant's wife refused to testify against her husband, hus-band, having becoms reconciled, and the State could not make a case without her-evidence. her-evidence. . 8ALINA: There are more than fifty cases of smallpox in Salina and notwithstanding notwith-standing the efforts of - our Board of Health, the disease is spreading rapidly. William Crowshaw. an aged man living alone inBrlgham, was found dead In a big ditch near his home yesterday afternoon. Crowshaw was subject sub-ject to fits, snd it appears that he had fallen down the steep bank and Into the water while thus afflicted. He has not been mentally sound for some time, and some attempts hays been made to have him examined as to his sanity. While he owned some real estate, he has been a charge of the county and ward, as he was unable to take care of himself. EUREKA: Lee Hopper of Eureka was appointed City Justice of the Peace by Mayor Gear at a special session of the City Council. He will fill the unexpired term of T. M. Holland, deceased. Mr. Hopper has lived in Eureka for several Je&rs, snd served one term as Precinct ustice of the Peace. SPANISH FORK: Justics Banks of Spanish Fork yesterday discharged Robert Rob-ert Cook, after a preliminary examination on the charge of assault with a deadly weapon with Intent to do bodily harm, growing out of a stabbing affray in which Henry Cornaby of Provo was cut in the abdomen by Cook on the 26th of last month, PARK CITY: Thomas Manis, an employee em-ployee in the Hanauer tunnel, was yesterday yes-terday badly crushed. The causa of the accident is not definitely iwown, but it Is thought to have been a cave-in. . Mr. Manis was found lying unconscious. ' The doctors were immediately summoned, and after an examination found that has head had been crushed and some ribs broken. The accident occurred about S o'clock and the injuries may prove fatal.
