Show TRUSTEE'S SALE. v WHEREAS: JOSEPH NICHOLS AXft his wife. Sarah Nichols, by a deed of trfjst dated December 1. 1900. and duly filed for record In the office of the County Recorder Record-er of Salt Lake county. State of Utah, on-the on-the 3rd day of December, 1900. and thereafter there-after duly recorded in Book "4-Y" of Mortgages, page 348, conveyed to Glen Miller, trustee, the following described real estate in the county of Salt Lake and State of Utah, to-wit: . The northeast quarter of the northeast north-east quarter of section nine (9). and the southeast quarter () of the southeast quarter () of section four (4) in township fcur (4) south of range one (1) west of Salt Lake meridian, together with all water rights thereunto belonging. In trust, however, to secure the payment pay-ment of a certain note for ninety dollars, executed and delivered by the said Joseph Nichols and Sarah Nichols, payable according ac-cording to the terms stated In said note and in installments as follows: Nine dollars dol-lars on the 1st day of each June and December De-cember until said note should be paid in full; ald note being of even date with said trust deed and bearing Interest at the rate of 2 per cent per month from maturity maturi-ty until paid; and Whereaa; Default has been made tn the Installment of principal of nine dollars, due on the 1st day of December, 1&3, by reason of which said default all the principal prin-cipal sum unpaid on said note, amounting to forty-five dollars, has, by its express terms, become wholly due snd the legal holder of said note has declared the same wholly due; snd Whereas; It Is provided that In case of the refusal to act of said trustee, then the Sheriff of Salt Lake county, or his deputy then acting, may act as successor in trust to said trustee; and I Whereas: Glen Miller, the said trustee, has refused to act In said capacity and -the undersigned, C. Frank Emery. Sheriff of Salt Lake county, has been requested to act as successor In trust by the legal holder of safd note and deed of trust; . Now. therefore, notice la hereby given that the undersigned, successor in trust, pursuant to the power vested In him by said trust deed and at the request of Mary Davitt MacCord. the legal holder of said note, will sell at public sale to the highest bidder for cash at the west front door of the county courthouse of Salt Lake county, Utah, on March 12. 1904. at 11 o'clock a. m.. the real estate above de scribed, to satisfy the said cote and If, terest, and the expense of executing th' 1 trust, including a reasonable attorney counsel fee.
