Show REHEARING FOR M0YER DENVER, June 9. Attorneys for the Western Federation of Miners are preparing pre-paring an application to the State Supreme Su-preme court for a rehearing in the case of Charles H. Moyer, president of the "Western Federation of Miner, who is held a a military prisoner at Telluride by order of Gov. Peabody. Explaining the Supreme court's recent re-cent decision refusing to order Moyer'tt release on a habeas corpus writ, Attorney-General Miller has said that the court merely decided that the Governor has Kupreme light to pay when a county coun-ty is In a state of insurrection, that his decision Is not subject to Inquiry by any co-ordinate branch of the Government, and that the Governor, acting within his authority, may arrest a participant and detain him during the insurrection. The court has not decided. Mr. Miller declares, that the courts are without jurisdiction to compel the military to answer concerning arrests and detentions, deten-tions, and the Supreme court has reserved re-served the right to pass uion this question ques-tion fully if necessity arises. This reserved re-served power, the Attorney-General pays, means the supremacy of the civil authority over the military. The power to declare martial law and suspend the writ of habeas corpus, he says, has not bctn granted. |
