Show WOMACK HELD POR TRIAL ON A CHARGE Of TiURDER TOR KILLING MATTHEWS Frank Womack, -charged with mur- j der in the first degree for the killing of Joseph S. Matthews, on the night of October 22, whose 'preliminary hearing was held last week, was held to answer In the District court on the charge, by Judge Diehl today. In delivering the decision of the court this morning. Judge Diehl said: "If It were not for the fact that the evidence disclosed the tic), that when Womack was called by Matthews, he armed himself him-self with a loaded revolver, the defendant defend-ant should have been discharged. Armed Himself First - . "The fact that he did arm himself Immediately prior to the conversation, makes a different phase of the case. I feel that under the circumstance it Is the duty of the court to have the matter mat-ter investigated by a higher court than this,-and before a Jury. It deserves a fuller and more complete investigation than has been given it in this court." Claims No Malice Shown. I Col. M. XT. Kalghn, representing Womack. Wo-mack. suggested that no malice on the part of Womack had been shown by the prosecution, and asked that Womack Wo-mack be held for trial on a manslaughter manslaugh-ter charge in order that he might endeavor en-deavor to procure ball.
