Hamilton, cf Mill Creek, tlie defendant was arraigned on a charge of unlawful conabita-Uonwlth conabita-Uonwlth Mrs. Isabella Hamilton and Mrs Belle White Hamilton. He entered a plea of not guilty.. The case of the United States -vs. Wm D. Xewsom, indicted for unlawful un-lawful cohabitation with Mrs. Catharine Kewsoni and Mrs. Lucy Devereux Xewsom, was taken up for trial und a jury called. Before taking the evidence, the named of tho witnesses were called. When that or Lucy Devereux was reached there was no answer. She had not been subptenaed, and the officers reported that she could not be found. She had given J200 ball when before the commissioner, and this bond was declared forfeited. Her friends say sh was never notified, noti-fied, and did not know of the trial or she would have appeared. Mrs. Catharine Xevtsom testified I am the defendant's legal wife, and do not wish to testify. Excused. Mrs. David John testified I know Mr. New som and his family; Lucy Devereux was reputed to be his second wife; when lie came out Lucy moved to another house; I saw-Mr. saw-Mr. Xewsom on the occasion stated by my husband; he was in soldier's clothes; he was leaning on the fence, a little distance from tlie gate, and Lucy was taking a Toby carriage through therate. Arthur Cabbie testified In the winterof 1SS9 1 took Lucy Devereux to the depot; Mrs. Xewsom employed em-ployed me; I did not see Mr. Kcw soui; Mrs. Swain went to tlie depot with us. To Mr. Moyie I took herfrom the corner bouse; Mrs. Xewsom lived in a dillerent house, on the same lot. Mrs. Mary Swain testified I went to the depot with Lucy Devereux and her little boy, In October, Oc-tober, 1SS5; Mr. Xcwsom was not home af the time; lxt fall there was a baby there: it culj walk in October, Oc-tober, 1SS9; I Judge It was about a year old. To Mr. Moyle The baby I saw was reared by Mrs. Xewsom; she got It when it was a few days old. To Mr. Variau Lucy did not bring the child to my house when the officers came; Mrs. Xewsom brought it; she had a tussle with Deputy Springer; he bolted Into tho house and took hold of the child. Deputy Springer testified 1 arrested ar-rested Mr. Xewsom in 1ES9; adjoining adjoin-ing the store J. found Lucy Dev-ercirx Dev-ercirx and two children; Mr. and Mrs. Xewsom were in the yard at the rear of Uio stole; Mrs. Xewsom was frightened; she took the youngest young-est of the two children and ran across the street; I ran after herand got the child. To Mr. Moyle I had no warrant for the baby; Mrs. Xewsom claimed that it was her child; I told her she had no business to go out of the houe with It. Jeputy Cannon testified that he arrested Mr. Xewsom, and saw two ladies there; the one supposed to be the second wife told him her name was Bailvy. - Mrs. Stein 'testified Lucy kept the store with Mrs. Kate Xeweom; I livedln the house adjoining tlie store, Mrs. Xewsom had a young baby there, and Lucy had two older children; Mr. Xewsom and I were not good friends; Mrs. Xewsom told me a midwife gave her thebaby w hen it vaya few days old. To Mr. Moyle 1 only saw Lucy at the store. Mrs. E. W. Stain testified Lucy Devereux and Mrs. Xewsom lived in separate apartments; 1 saw a baby with Mrs. Xewsom; it vras about a year old when Mr. Xewsom was arrested. Mr. Varlan Are you a married woman? To Mr. Variau I came to court because I had to. Miss Mary Dixon testified Miss Lucy Devereux was at my home in Provolast November; she had two children; she wasnnt confined there. Isaw her last about four months ago, InProvo. MrTTsewsom now lives at Provo; I never saw Jjucy at his house; I never saw them in each other' company. , .Mr.Sran Dixon testified-Mr. and Mrs. Xewsom live in Provo; I met.Lucy Devereux on the street about six months ago; never saw her anywhere elsei Mrs. Elizabeth Benton testified I saw Lucy Devereux about a year and a half ago; she was caacnle. The case was submitted to the jury without argument. After being out twenty-five minutes a verdict of guilty was returned by-them. The defendant was ordered to appear ap-pear at 2 pan. for sentence. A few minutes pasti, he appeared, and received re-ceived a brief lecture 'frum Judge Zane. Upon declining to make any promise as to his future conduct, he was given the lull twnalty of the law six months' Imprisonment and a fine of $309 and costs. A case of a different nature was taken up and proceeded with. The defendant is -oon-"Mormon," Ju-lius Ju-lius Hauerbaoh; -and is accused of fornication committed on April 1. IS9, with Sarah Pierey.
