Show Constitutional Amendments Constitutional Amendment No. 1 A Joint Resolution Proposinf in Amendment Amend-ment of Section 1, of Article VII. of the Constitution Relating to the Stole Executive Execu-tive Department, the Terms, Residence and Duties of Officer. (Superintendent of Public Instruction.) Be It resolved hy the Leirlslature of the State of Utah, two-thirds of all the members mem-bers elected to each house concurring therein : SECTION 1. That lt (i proposed to mend Section I, of Article VII, of the Constitution of the Stat of Utah u follows: fol-lows: SKCTION 1. The Executive Department hall consist of Governor, Secretary of Stnte, State Auditor. State Treasurer and Attorney-General, each of whom shall hold his office for four yearn, beginning on the first Monday of January next after his election, except that the terma of office of those elected at the first election shall begin when the state shall be admitted into the Union, and shall eJ.id on the first Monday Mon-day in January, A. D. 1901. The officers of the Executive Department, durinff their terms of office, shall reside at the neat of fovernment. where they shall keep the public pub-lic records, books and papers. They shall perform such duties as are prescribed by this Constitution and as may b prescribed W law. SECTION 2. The Secretary of State Is hereby directed to submit this proposed amendment to the electors of the state at the next ceneral election in the manner provided by law. SECTION 3. Constitutional Amendment No. 2 A Joint Resolution Proposing an Amendment Amend-ment to Section 10, of Article VII, of the Constitution Relating to Governor's Appointive Ap-pointive Tower and the Filling of Vacancies Va-cancies In Certain Offices. (Superintendent (Superin-tendent of Public Instruction.) Be It resolved by the I.egialattirt of the Sta'.e of Utah, two-thirds of all the members elected to each house concurring concur-ring therein: SECTION 1. That It Is proposed to amend Section 10, of Article VII, of the Constitution of the State of Uuh, as follows fol-lows ! SECTION 10. The Governor shall nominate, nom-inate, and by and wfth the consent of the Senate, appoint all State and district officers offi-cers whose offices are established by this Constitution, or which may be created by law, and whose appointment or election is net otherwise provided for. If, durinn the recess of the Senate, a vacancy occur in any State or district office, the Governor .shall appoint some fit person to discharge the duties thereof until the next meeting of the Senate, when he shall nominate some person to fill BUch office. If the office of justice of the supreme or district court, Secretary of State, State Auditor, State Treasurer, or Attorney-General be. vacated by death, resijrnfttion or otherwise, it shall be the duty of the Governor to fill the same by appointment, and the appointee shall hold his office unfit his successor shall be elected and qualified, as may be by law provided. Constitutional Amendment No. 5 A Joint Reselntion Proposing to Amend Article XIII, Secti.-n 2 of the Constitution Constitu-tion of the Mate of Utah, as Amended at the General Election io 1930 Relating to Taxation of Tangible Property, Ascertainment Ascer-tainment -of Value, Exemptions, and ths Annual Tax for the State. Be it resolved by the Legislature of ths State of Utah, two-thirds of all members elected to ach House and two-thirds of all members of each House concurring therein : SECTION 1. That it is proposed to amend Article XIII. Section 2 of the Constitution Con-stitution of the State of Utah, as amended at the general election in 1930, to read aa follows r SECTION 2. All tangible property in the State, not exempt under the laws of the United States, or under this constitution, shall be taxed in proportion to its value, to be ascertained as provided by law. The property of the United States, of the State, counties, cities, towns, school districts, municipal mu-nicipal corporations ajid publio libraries, lots with the buildings thereon used exclusively-or either-religious worship or charitable char-itable purposes, and places of burial ntit held or used for private or corporate bene-1 fit, shall be exempt frcm taxation. Water rights, ditches, canals, reservoirB, power plants, pumping plants, transmission lines, pipes and flumes owned and used by individuals indi-viduals or corporations for irrigating lands within the state owned by such individuals or corporations, or the individual members thereof, shall not be separately taxed as long as they shall ba owned and used exclusively ex-clusively for such purposes. Power planta, power transmission lines and other property proper-ty used for generating and delivering electrical elec-trical power, a portion of which is used for furnishing power Air pumping water for irrigation purposes on lands in ths State of Utah, may be exempted from taxation taxa-tion to the extent that such property is used for such purposes. These exemptions shall accrue to the benefit of the users of water so pumped under such regulations as the legislature may prescribe. The taxes of the Indigent poor may be remitted or abated at such times and in such maner as may be provided by law. The legislature may provide for the exemption from taxation taxa-tion of homes, homesteads, and personal property, not to exceed $2,000 in value for homes and homsteads, and $300 for personal per-sonal property. Property not to exceed J3.000 in value, owned by disable' persons who served in any war in the military service serv-ice of the United States or of the StaU of Utah and by the unmarried widows and minor orphans of such persons may ba exempted ex-empted as the legislature may provide. The legislature shall provide by law for an annual tax sufficient, with other sources of revenue, to defray the estimated ordinary ordin-ary expenses ot the state for each fis;aJ year. For the purpose of paying the state debt, if any there be, the legislature shall provide for levying a tax annually, sufficient suffi-cient to pay the annual interest and to pay the principal of such debt, within twenty years from the final passage of the lav? creating the debt. That it is proposed to amend Section 8. of Article X, of the Constitution Con-stitution of the State of U:ah, as follows: SECTION 8. The general, control and supervision of the Public School System shall be veMed in a State Board of Education, Educa-tion, consisting of such persons aa the Legislature may provide. SECTION 2. The Secretary of State is hereby directed to submit this proposed amendment to the electors of the state at the net general election in the manner provided by law. SECTION 3. Constitutional Amendment No. 6 A Joint Resolution Proposing to Amend Section 9. Article VI of the Constitution of Utah, Relating to Compensation of Members of the Legislature. That it fa proposed to amend Section 9. Article VI, of the Constitution Con-stitution of the State of Utah, as follows: SECTION 9. The members of the Legislature Legis-lature shall receive such per diem and mileage mile-age as the Legislature may provide, not exceeding ex-ceeding eight dollars per day and ten cents per mile for the distance necessarily traveled trav-eled going to and returning from the place of meeting on tho most usual route, and they shall receive no other pay or perquisite. per-quisite.
