Show MR CASE BEING UD IN COURT Auto Seized in Liquor Raid Is Defendant in Action at Ogden. Special to Tbe Tribune. OGDEN, Nov. The fatte or the Paige automobile, which was seized by Sheriff H. CV Peterson and deputies in Weber canyon in December of last year and now a defendant in the case of the state in which an order for the confiscation of the oar is sought, will not b'e determined until Monday when the case goes to a jury in Judge A. E. Pratt's division of the district dis-trict court. The car is said to be the property of Mrs. F. E. Kerrand. of Salt Lake, who is one of the defendants, together with A. J. Davis, who was driving the car when it was seized, and Charles McSwine of Salt Iake, who is alleged to have purchased Mrs. Ferraud's promissory note given to secure the purchase of the car. The case was called for hearing in court this morning and up to a late hour tonight the time was consumed in the taking of testimony. Sheriff Peterson and Deputy Siieriff Dick Wootton toid of the seizure of the car. Mrs. Per rand claimed that the car had been taken from her garage without her knowledge or consent. It was shown that the automobile in question had been seized a second time within two days from the time of the release re-lease of the car after it had been taken by the sheriff's officers in a liquor raid. The case the first time mas heard by Judge Pratt, who ordered the car released to Mrs. Ferrand. The second time the car was taken was in Morgan county, which is Judge Pratt's district, and he is again the judge in the case. The arguments in the case will be made Monday aud the case will then go to the jury. |
