Show REPLACING OF CANAL DAM, OBJECT OF SUIT Suit was begun yesterday In the Third district court to compel the North Point Irrigation company and others to replace the surplus canal dam which was washed out May 21. 1018. or for the appointment of a receiver for the company to con- 1 struct the dam under court order and : asserH the costs against the compa ny. j The plaintiffs in the action are Thomas L. Lawson and associated landowners. For months past representatives of the company have been endeavoring to corne to a working understanding with the city whereby the city would pay half the cost of rebuilding the darn. City commissioners com-missioners have questioned their leg;il right to vote money for the purpose. Jn the meantime the farmers dependent upon the North Point canal, which has its Intake In-take at the fcii.e of the darn, have brought the present action, a llegiriK' 'hat the dam washed out because of negligence on the part of the company's agents. They allege further that their lands hyve been left without suffkient Irrigation Irriga-tion water during the pu-t season, git-ally to the injury of t heir crops. |
