Show ECHO OF POLITICAL CAMPAIGN HEARD Special to The Tribune. OGDEN. Sept. 23. An echo of the po- ' litical campaign of two years ago was heard in the district, court before Judge A. YV. A gee this afternoon, in the case of the Home Pa ttern company against William C. Howell and Jennie Howell, when Howell filed an affidavit asking: for a change of judges in the case. The affidavit set out that the presiding judge had expressed an unfavorable opinion opin-ion of the defendant and Howell said he did not think Judge Agee could give him a fair trial. The wording of the affidavit, af-fidavit, in part, was as follows: '"The said A. W. Agee has expressed a highly unfavorable' opinion of this defendant, de-fendant, and has called him a 'crooked politician' and has used similar terms in speaking of this affiant." When the affidavit was read Judge Agee said that he knew his conscience was clear and that he could give Mr. Howell a fair trial, but that his opinion of him had not changed. The case was set for hearing November 6. Two years ago Judge Agee was a candidate can-didate against Judge J. A. Howell, a brother of William C. Howell. It was at this time that Judge Agee's alleged remark is said to have been made. |
