Show SUES FOR SEED CROP. Farmer Says Failure to Deliver Reaper Cost Him $2000. Special to The Tribune. OGDEN. June 2S. James Allen of Trc-monton Trc-monton has begun suit against the Burton Bur-ton Implement company of this city to recover. $2000. alleged damages done a crop of . alfalfa seed. The trial of the case was taken up by Judge Harris today. to-day. Mr. Allen avers that on August 20. 1010, ho contracted for a reaper to be delivered deliv-ered at his ranch In Box Elder county. August 24. He claims that the machine was never delivered and that by reason of tho failure of the company to keep Its agreement he lost five buHhels of alfalfa seed for every acre of ground ho had. there being forty-five acres to bo harvested har-vested The company declares that the machine was sold and an agreement to deliver It August 24, on a certain condition, that being that the officers of the company accent ac-cent Allen's note as part payment on tho machine, otherwise the company would not be bound In tho bargain. The defendant furthermore says that the note was "turned down" by the company, and It. together with S10 cash, which was advanced by the plaintiff as part payment pay-ment on the machine, were sent to the plaintiff August 25. at which time It, was explained that the sale was off. |
