Judgment was rendeicd before Judge Booth at Provo for $2000. Tadd wns Injured by some tics falling upon him. May G, 1907. between Spanish Fork and Sprlngvllle. The company contended, on appeal, that Tadd voluntarily assumed the risk of his employment and that the company was not negligent. It has been shown that Tadd was warned that he might get hurt. Upon this showing the supremo su-premo court reversed the lower court. Justice McCarty wrote tho opinion of the court, which is concurred In by his associates.
