In the district court here today the cnuo of Herman Rutzko ot nl. against tho Denver it Rio Gmndo Railroad company wns compromised, by the company confessing Judgment In favor fa-vor of the plaintiffs for 55000. This ends the litigation growing out of tho denth of Mrs. Herman Rutzko and two children chil-dren at ScoMeld in February. 100f. Mrs. Rutzko, with two small children, had been visiting with friends at ScoMeld nnd was on hor way homo to Winter Quarters. Sho and hor two children were walking along the railroad track, which was banked on each side by ti solid wall of snow. Two cars which had broken loose from a train at Winter Quarters rushed down tho steep grade, killing both tho mother and the children. Tho accident attracted considerable attention at-tention at the time on account of the circumstances connected with It. Tho widowed husband and- tlu remaining children brought suit agnlnst tho mil-road mil-road company, which suit has now been compromised. |
