Nielsen's desire to kill Duncan grew out of the failure of the attorney to prosecute a suit which he had brought for Nielsen against Sheriff Harmon of Utah coilnfy, the charge being false imprisonment, following the arrost of Nielsen and his incarceration in the State Mental hospital last year. After leaving Duncan. Nielsen went to the attorney's office, whore he found C. M. Neilse'n, the. attorney, who is Duncan s associate. 1 hero Nielsen contented con-tented himself for a time, but he soon became unmauagonblc, drew a big gun and declared that he would kill Duncan Dun-can as soon as he laid eyes on him. lie also threatened to kill Attorney Neilson, who finally managed to escape from the ofiice and notify the police. Officers Burt and Golding responded, and when the officers entered tho office of-fice Nielsen flourished his gun and declared de-clared that he would kill the first man who attempted to appronch him. The situation was delicate, but Of-fleer Of-fleer Burt walked up to Nielsen and disarmed him. As tho officer approached ap-proached tho madman, t Nielsen shoved i Iiis gun against Burt's stomach and tried to pull the trigger, but the gun was not discharged. All thrso facts and others, which were published at tho time of Nielsen's arrest, came out in tho testimony of witnesses at Thursday Thurs-day 's hearing. Nielsen has a wifo and eight; children chil-dren at Pleasant Grove, but Emma, tho fiftocn-ye.ir-old daughter, wns the only member of the family present. Tho little girl nearly went into hysterics at the close of the hearing and was Inken into the private office of Judge Armstrong, whero she finally composed herself. Nielsen is a small man, but it took tho combined strength "of Deputy Sheriffs Sher-iffs Steele and Sharp to control him, despite the fact that ho was muffed. |
