Charles E, Brubakcr Is accused by tho management of tho Brubaker-Campbcll Hardware company of circulating rumors about tho company to enablo him to hc-puro hc-puro some chares at a price bolow'thc real value. Judge Morso has signed a temporary tem-porary injunction restraining Brubaker and tho National Bank of the Republic from selling seventy-three shares that the bank is holding as collateral security. Tho complaint states that on February 7 tho defendant, Brubaker, was in debt to tho bank for S2S0O. Tho company took up his note, depositing stock certificates for sovonty-threo shnrcs as collateral and making a cash payment of $1600. Then, tho complaint goes on to say, after that day Mr. Brubaker has gone nround knocking tin company; saying that tho stock In trade waa not worth 50 cents on tho dollar, and that the company wa3 Insolvent. In-solvent. Ho has, It Is alleged, been advising ad-vising other merchants not to sell tho Brubakcr-Camnbell Hardware company any goods. The complaint claims that these statements uro untrue and without foundation and are mndo with a view to causing a depreciation In tho market and truo valuo of tho shares of stock deposited depos-ited with tho .National Bank of tho Republic. Re-public. The plaintiff say6 that tho value of tho shares Is greater now than It was when lliey were deposited. Tho complaint stated that tho shares would havo been sold at noon yesterday had tho restraining order not been signed, nllhough no notice had been served upon tho plaintiff. |
