Show TO RESTRAIN THE GOULDS Suit Against the Trustees Goes Over Until December117th C New York Dcc 3The suit of An tone J DIttmar against George J Gould Howard Gould Edwin Gould and Helen M Gould as trustees under the will of Jay Gould to restrain them from paying the Count and Countess de Caslellane any portion of their income in-come from the Gould property was called hi the Supreme court today before be-fore Justice Leventrltt Col E C James who appeared as counsel with Charles A Gardiner on behalf of the Gould family asked for an adjournment on the ground that the affidavits had not been obtained from France from the Countess and Count de Castellane A representative of the law firm of1 Guggcnhelmer Untermeyer Marshall Mar-shall attorneys for DIttmar asked that the matter be held over until tho second call of the calendar and Justice Leventrltt acquiesced The case was adjourned to December 17th Col James th > nttnrnr for Hip Goulds made an additional l application to have the injunction order modified to the extent that the trustees could pay out of the Income of the trust funds at the rate of 25000 a month to the Countess Castellane pending the final decision of the motion This application ap-plication was opposed by Mr Untcn 1 myer counsel for the plaintiff and after af-ter discussion the Judge directed all the parties In Interest to appear nu Justice Fitzgerald who granted the original order IMr Gardiner sal at his ofllce subsequently subse-quently that the matter had been quent tha matel arranged ar-ranged without appearance before Judge Fitzgerald In the following manner Pending the hearing and determination de-termination of the Injunction motion the trustees of the estate of Jay Gould are permitted to pay to the Countess Castellane onetwentieth of 250000 each month on the first day of the month beginning with the first of December De-cember l O and except as thus modi l fled the Injunction order Is to remain for the present as originally proposed by Judge Fitzgerald |
