the Senate and Mr Cook had been represented repre-sented by Speaker Stiff of the Mont Mon-t im IToiiKCjnB having tried to Induce nywlovolevfor iCinohej consideration Both denied these charges Mi Jaqueth said he never before saw the envelope in which the 5000 said to have been intended for him had been placed Mr Cook declared that he never but Once talked with Mr Stiff concerning the contest for the United States Senate Sen-ate and then Mr Stiff had brought up the subject suggesting that he might cast his vote for Mr Clark for the Senate Sen-ate for 30000 but that he Cook had said that he was not interested In the Senatorial contest to this extent A half dozen other witnesses were examined all by the defense and each in refutation of some testimony offered by time Prosecution At the opening of the session Mr I Campbell attorney for the prosecution produced the affidavit of I Hill which that gentleman had testified had been altered by i himself and Mr Campbell Campuel I Mr Campbell said he luid made no changes in the document WANTED LETTER RESTORED I At this Juncture Attorney Foster of Senator Clarks side asked that Mr Campbell be compelled to restore to Air 1 I nickford the loiter which had been stolen in V Us transmission He re ferred to tho letter from BIclcfoid to Ben Falk which Hill said had been taken from him and takCn opened by CJamp bell when he was the purchase of 57000 worth of sheep by himself and Representative Lockhart of the Montana Mon-tana Legislature which had been paid for with money borrowed by Mr Lock hart at the bank of Clark Bro In Butte R HODGESS STORY James M Hodges Receiver of the Land office at Miles City told of a proposition which he said had been made to him In Helena last winter by John R Toole a member of the Montana Mon-tana House of Representatives to assist as-sist in preparing for the contest of Mt Clarks sent He had asked Mr Toolcs assistance in the fight against the Rosebud Rose-bud county bill Toole had told him that ho would give the help but that in return he wanted his witness help Mr Toole had said to him that he and his friends had just been beaten by Mr Clark In the contest for the United and had not since talked with Mr Stiff on tho question of the Senatorial contest Mr Cook said that he had been Interested Inter-ested In Mr Clarks behalf but that being a Republican he had not prosecutions witness Rector had said that he had never asked Rector to hold money for him not having known the mon monJAQUETHS V JAQUETHS DENIAL Jaqueth Is one of the members of the Legislature for nor had he ever re coJvcd any money for his vote for Mr Clark for the Senate He had he said only voted for Mr Clark because of the I decision of the Republican caucus In his behalf V and because ho The payment pay-ment had been made with money received re-ceived on two 3000 contracts with the Government He was shown the envelope en-velope which it was claimed contained tho 5000 that had been given him by Mr Clarks supporters He said he had never before seen the envelope and that the Initials on it were not in his handwriting V WARNED BY COUNSEL COUSEL I He was asked to write his initials already had one letter stolen he said referring to the letter which Ben Hill had said Mr Campbell had taken from him CAMPBELL AGGRIEVED Mr Campbell replied to this remark saying that lie considered it an insult Chairman Chandler said he considered consid-ered Mr Fosters remark accidental and hoped that the language would V not be used again Mr Foster responded that he considered consid-ered the
