Show TRUSTEE S SALE- WHEREAS LEONARD S. Osgood and Rama L. Osgood, his wife, ! on the firt day of December, 1.-91. made, executed ' ami delivered to Emil I. Kaddatz their certain i promissory note for tks principal sum of three i thousand three hundred and sixteen 90-100 dollars, j payable to the order of said Basil J. Raddata, i ninety days after date tliereof, with interest there- on at the rate of one tl) per cent per month until i paid, and ! Whereas, To secure the payment ot said note i the said Leonard 8. Osgood aiid Ruma L. Osgood j on eaid day made, executed and delivered to S. HcDowall as trustee for the said Emil J. Rad-; Rad-; datz their certain trust deed in writing of that date, whicu said trust deed was dulv certified, acknowledged and re orded in the oftlce of the i County Recorder of Tooele County, Utah Terri-: Terri-: tory, on the third day of December, 191, and j thereby conveyed to said McDowaii the following i mining property, tow-it. : An undivided three- fourths ) interest of, in and to the "No-U-I Don't Lode, mining claim, situate in the Rush Valley Mining District in the said County of i Tooele, designated as U.S. Survey, lot No. 88, and i mere particularly described in and by said trust ' deed. Also an undivided three-fourths inter- est of, in and to the Laura Lode, mining claim, situate in the said Rush Valley Mining District, County of Tooele, Utah, more particularly described de-scribed in and by the location certificate thereof I recorded in Book F, at paire 182 of the records in j the office of the District Recorder of said Rush Valley Mining District and in and by said trust deed. Also one (1) upright toiler, engine and blower now upon said -'No-U-Don't mining claim, and Whereas, it is provided, in said trust deed that in case default be made in tho payment of said promissory note, that the said trustee might proceed pro-ceed to sell, anil sell an l dispose of said premises or any part thereof, cad ai7 risht, title, benefit and equity of redemotion of the said Leonard S. Oscood and Rnma L. Osgood, their heirs and assigns therein either in mass, or separate parcels par-cels at public auction on said premise- or any part thereof, for the highest and best price the same will bring in cash, twenty days previous notice of such sale having been given by publication pub-lication in any rewspaper at that time pub-I pub-I lished in the county of Salt Lake, Utah Terri-I Terri-I tory, and oat of the proceeds of such sale, first to pay the cost of advertising, selling and conveying con-veying said premises, including a reasonable I commission to the trustee for bis ervices and a j rea- onable attorney's fee and all other expenses : of this trust. Secondly, to pay to the holder of said prom is-I is-I sory note such sums as he may have paid for ', taxes or assessment on said premises, or to ex-: ex-: tinrrnish any outstanding title or liens thereon. Thirdly, to pay the fail amount of said promissory promis-sory note, together with interest thereon, and, i whereas, the said Leonard S. Osgood and Emma L. Osgood have not paid said promissory note, nor j any part theroof. and tiie same is past due and I payable Now, therefore, in consideration of the j premise-, and of the power vested in me by said Trust Deed and by request of the legal holder of j said promissory note, I will, on Monday, the ( 15th) Thirteenth day of June, 1892, at 1 o'clock 'p,m. on said day, at and upon said "No-You-Don't Mining ciaim. in the said County of Tooeie, sell said described property to the highest bidder for cash, or so much thereof as may pay said note and interest thereon, trustee's anil attorney's fees and the expenses of said trust as provided in laid trust deed.
