began his opening statement be before before before fore the Jury In the Beers murder case Fifteen minutes before that time counsel for both the state and the defense an announced announced announced themselves as satisfied with the Jurors in the box Mr Halverson Halver n spoke for ff minutes and immediately thereafter the taking of testimony was commenced Yesterday wad wn the fourth day of the trial and at its opening there were ten Men lien in the Jury box who had been ac accepted accepted accepted by both sides side S two taro who had not yet jet et been passed pas ed upon and one vacant Feat Beat In the court room were the twenty five men who composed the special ven venire venIre venire ire ordered the day da before During the forenoon session which lasted but an hour hours William Knight who had been passed for cause by the defense the day da before proved acceptable to both sides and was nas sworn In as the tenth mem member member ber of the Jury A D Young the sec second ond rd man to te be called from the new panel also proved satisfactory to both the state and defense and Albert E Becker qualified qualified fied for the twelfth juror The district attorney talked In an even tone but at times grew somewhat dra dramatic dramatic dramatic matic especially when he said that Dr Beers was heard to cry out My God Walker Valker dont kill me Several times during his talk Frank Beers father of the theman theman theman man alleged to have been murdered cov covered covered covered ered his face with his hands bands as if to shut shutout shutout shutout out the awful scene of or the crime as pic pictured pictured pictured by Mr Ir Halverson Once only did Walker Valker show that he was affected by the remarks of the district attorney That was when counsel for tor the state was de defining defining defining fining the difference rence between murder in inthe inthe inthe the first and second degree and involuntary Involuntary tary tar and amid voluntary statement stated several times that If the defense was able to justify the crime the state would Join with them in asking for foran foran foran acquittal an j Outlines the Story Mr r Halverson in detail went over oer the history of the crime as was brought out at the inquest and preliminary hearing in the lower court He detailed the visit of the defendant and A E Lawrence his codefendant to police pollee headquarters on Sept 17 the night preceding the tragedy He told of the conference with Police PolIe Captain C C Brown with regard to the tho breaking up of the Intimacy between Beers and Walkers wife of their calling at the Colonial rooming house where was the office of the medical company with which 11 Beers was connected and where when he had his room of their going to and entering Beers room although he was ab absent absent absent sent at the time of their conversation with Mrs Irs Gasberg the proprietress and then of the events the next day which led up to the tragedy proper He gave a n diagram of the store of the Electrical Supply Fixture company com pan and told of or Beers being invited by Lawrence at Walkers request to call there and then what happened In the rear rooms as far fat faras faras as was known to the prosecution In telling tell telling tellIng ing of the testimony that would be given by Mrs Irs W V F Hull and daughter and some of the of the store the district attorney grew dramatic and rais raised raised raised ed his voice above the even tone in which he lie had been speaking He said he could not and would not attempt to describe the pitiful cries heard by those in the store at the time and by the Hulls in the apartments above but would leave that for the witnesses themselves He con continued continued continued with his story of the events con connected connected connected with the alleged crime up to the time Dr Beers reached the hospital where he died At the close of the remarks of the dis district district district attorney Judge Howell Instructed the attorneys to proceed with the taking of testimony Architect J A Smith was the first witness called He testified to making the chart or diagram of the store in which the tragedy was committed which is to be used in the trill of tho the case Following the time architect the state called Police Captain C C Brown The witness told of the visit of Walker Valker and Lawrence to the police pollee station on the night of Sept 17 at about 11 of their exchanging ing cards with him him and of the presenta presentation tion of a letter given to Walker alker by Chief McKenzie of oC the Salt Lake police pollee to be handed to Detective Shannon Sham on who hail had been in Ogden but who had since gone gona back to Salt Lake LakeIn In telling of the conversation that passed between them at the city Jail Brown stated that Walker had told him his wife nife had been lured away by Dr Beers and in m order to get her out of his Influence he had sent her to Los Ange Anse Angeles Angeles les Brown said Walker Valker told him that he understood that Beers Intended follow following followIng following ing her there thero and that If wanted to pre prevent prevent prevent vent this Captain Brown said that he told Walker alker he would take the matter up with Beers in the morning and report to Walker Valker as to how he succeeded Captain Brown Cross Examined I Attorney W R Hutchinson then took the witness in charge and subjected him to toa a searching s cross examination Wit Witness Witness Witness ness said Walker alker told him further that he and his wife as well as Dr and Mrs Beers had apartments at the same hotel In Salt Lake J ke that they had associated freely together that became Infatuated with Beers that she appeared I to be mesmerized that he wanted to take her away awa from the man and his In Influence Influence influence fluence Brown said that Walker alker had said that their married life had been pleasant until the meeting with Dr Beers I that lie he had said that there was vms nothing noth nothing ing In wrong with his wife up to that time and he wanted to save her before she had gone gono too far and that Walker Valker wanted the chief of police pollee in Salt Lake notified xhi n case Beers started for Los Angeles Brown also stated that Walker appeared to be calm at the time of the conversa conversation conversation conversation tion and when told that It would per perhaps perhaps haps Imps be best if he did not go along to see seethe seethe seethe the doctor he expressed his intention of returning to Salt Lake the following morning Mrs J S Gasberg proprietress of the Colonial rooming house bouse was the next witness She told of the rooms Tooms occupied by Beers the medical company and others connected with the concern She also testified as to Walker and Lawrence calling there the night before the trag tragedy tragedy tragedy edy and asking for Dr Beers of their going to his room and going In although althou h I he was nut not in at the time She said she heard a noise as If the th dresser drawers were being opened and closed and she reprimanded them for taking such liber liberties liberties liberties ties that Walker Valker asked her if she know who he was She told him she slie care that he had no business doing what he did and that after waiting fOr some sometime sometime sometime time Lawrence and Walker Valker left the place together On cross examination counsel for the de defense defense defense tried to bring out facts concerning alleged trips of Beers and Mrs Walker to the Hermitage and the time European hotel and many other othet things not referred to in inthe inthe inthe the direct examination Question after question was excepted by counsel for the state slate on the ground that it was not proper cross examination all of which were sus sue sustained sustained tamed by the court courtAt At 5 Judge Jude Howell announced that he had decided de to hold court on Sat Saturday Saturday Saturday and continue the trial of the case so gO as to expedite it as much as possible In order that the Jurors might not become tired of their confinement so early In the trial Judge Howell furnished them with tickets to the theatre last night They at attended attended attended tended guarded by the officers in charge |
