Show CITIZENS BANK CASE Legal Battle On Again Judge Me Carty On the Bench The troubles of the defunct Citizens bank came before the court yesterday morning under the name of Eliz Warren et al vs Theo Robison et al Judge Roai and Judge Hart have each had to do with this case in some form or other and 011 this occasion Judge McCarty came up to try the case This is an action involving a claim of about SS7000 brought against the exdirectors arid officers of the bank for alleged mismanagement of the banks funds it being especially alleged alleg-ed that loans were made to the officers thfmselves or at least to corporations in which they were interested and that these loans were not paid There were several attorneys in the case A J Weber M D Lesseneer Elija Farr and Judge Bennett represented repre-sented plaintiffs L R Rogers Judge Thomas Marshall R H Whipple and T D Johnson represented various defendants de-fendants The case yesterday hinged most all day on the question of jurisdiction The defendants claimed that the receiver re-ceiver was the proper party to bring this action and that the receiver being an officer of the court the court should Imvp been appealed to to have the action ac-tion brought The plaintiffs claimed that the receiver re-ceiver had been made a party defendant defend-ant in the suit and that this was enough The testimony offered was for the most part as to whether the court or receiver had been asked to have an action brought The decision will be rendered this morning In the case of William Hayes vs Southern Pacific company plaintiff was granted leave to amend his proposed bill of exceptions by making the instructions in-structions of the court a part of the same |
