Show MERITS OFABRICK KILN 1 V Suit to Recover 15000 Damages Because of Alleged Defects JACK RICHARDS ACQUITTED HENRY M BYANS APPEAL DISMISSED MISSED BY CONSENT Josaph run on Trial For Cattle Stealing Josephine Washington Colored Granted a Decree of Divorce t vorc New Suits Piled in the Dis ifrict Court Probate Orders and Miscellaneous i Notes The trial of the C of the Utah I Portland Cement company vs the Cen terville Brick Kiln company was commenced and a jury menced before Judge Cherry jur yesterday with Attorneys J R Bowdle and C W Morse representing the I plaintiff and the Messrs Loofbourow I and William Kahn appearing for the defendants The ulaintiff sued to recover 15000 alleged to be due a damages sustained by plaintiff by reason of the failure of erected in Salt a certain brick kiln ereted V Lake at plaintiffs works under the supervision of an expert sent by defendant de-fendant to burn Portland cement bricks of the size of ordinary brick to a clinker of incipient vitrification as I guaranteed by the contract entered into between plaintiff and defendant on November No-vember 1 1893 for the erection and sale to plaintiff of said Boehncke kiln Plaintiff alleges it expended large sums of money in the furnishing and fitting up of the kiln and in paying expenses and salary of the Expert to plaintiffs damage in the sum named for which judgment is prayed The defendant alleged i gave no J guarantee that the kiln would do the < work as alleged by the plaintiff and further that its failure was owing to the fact that defendant did not use proper material for making Portland cement bricks and not to any defect y in the kiln itself Defendant further t alleged by way of crossccmplaint that plaintiff agreed to pay it 750 for the privilege of being allowed to erect and use a Boehncke kiln and that plaintilt haa only paid 50 leaving 700 due for which judgment is prayed The hearing was in progress at the hour of adjournment V |
