rejection was deci E11 = shI Ii stood 9 for and 4 against Had Callister and Wallace been present the probabilities are that the result would have been 10 to 5 the firstnamed councilman being one of Pratts champions cham-pions The pending contest was precipitated pre-cipitated when slderation of the report of the committee on fire and police was commenced Action on the report was deferred from last weeks meeting The committee unanimously recommended that the appointment be sent back to the mayor for reconsideration reconsider-ation in view of the belief that Mr Pratts candidacy is distasteful to the majority ot the council as well as to I the large majority of the taxpayers whose best interests would not be sub served If the appointment were confirmed con-firmed It was also stated by the committee that it believed the mayor desired to work harmoniously with the council for the rood and wefare of the public yet it was disclaimed that there was any intention of seeking to I dictate the appointment of a chief of police When it was in order to consider the committees report it was taken up and read by the recorder Councilman Council-man Howe moved the adoption of the report The motion was promptly seconded sec-onded and without any discussion whatever of the merits involved in the Question a vote was taken THE VOTE Councilmen Allen Buckle Fern Strom Howe Margetts Robertson Siddoway Weiler and Barnes voted for the motion to adopt the committees commit-tees report and recommendation while Diehl Morris Patrick and Romney announced an-nounced their votes on the finance committee com-mittee was taken up Patrick moved I that < u b laid ovcr tor one week because I be-cause of the absence of the committees chairman Councilman Wallace who had been unexpectedly called east on business but would return in a day or two Btckle wanted the bill read the first I time so that no long delays would en I sue before the ordinance became effective effec-tive He made the point that final action II ac-tion would not be attempted at this II time and that there could be no harm I done nor discourtesy shown in advancing advanc-ing the bill to its setond reading I Romney and Howe concurred in what Patrick and Buckle stated Both of the former however wanted to see consideration con-sideration of the bill expedited and at the same time to act courteously toward to-ward the absent chairman Morris suggested a special session this week because several appointments awaiting confirmation could not be acted act-ed upon until salaries were fixed Patrick announced a willingness to withdraw his motion which he said I he had made as a matter of courtesy Buckle called attention to Canisters absence in Denver and suggested that the same conditions would prevail as to absentees if a special meeting were attempted this week The bill was then read for the first time and filed for second reading next Tuesday evening For the reason that Chairman Callis ter of the committee on municipal laws vas not present and the council not wanting to violate the unwritten law on official courtesy consideration of the bill for an ordinance reorganizing the polic and prison petitioned for the enactment c idra i of an ordinance prohibiting expectoration expectora-tion on the streets in street cars and other public places It was desired that a penalty clause be attached and that notices of the ordinances provisions be posted in all public places Attached to the petition was the endorsement of Health Commissioner Dalby who submitted I sub-mitted that other cities had In the interest in-terest of sanitary regulations enacted similar ordinances The matter was re ferred to the appropriate committee A DISABLED FIREMAN A F Angell petitioned for the retention reten-tion of his brothers name Frank An gell on the fire department pay roll until such time as it may be determined whether his mental condition will permanently per-manently render him unfit for further duty It was represented that the fire mans condition is due largely to the excitement ex-citement attending the performance of his duties and also to an accident received re-ceived while on duty The petition was referred to the committee on fire and police TO IMPROVE THE CONDEMNED JAIL The following significant resolution offered by Councilman Robertson was adopted Whereas The city jail is not fit to be tenanted being in a flagrantly unsanitary unsan-itary condition and Whereas Such an institution is a disgrace dis-grace to any municipality and Whereas Every grand jury in the past ten years has condemned the present pres-ent quarters therefore be it Resolved That the prison committee commit-tee be empowered to place the jail in a sanitary and habitable condition at a cost of not exceeding 500 TWO MORE RESOLUTIONS A resolution offered by Councilman Howe was adopted directing the city attorney to prepare an ordinance making mak-ing the board of public works consist of the city engineer as chairman and the heads of the departments as members mem-bers in accordance with the mayors recommendation Another resolution by Howe was adopted authorizing the committee on fire and police to have the ceiling and walls of the police court room calcimined calci-mined and papered and new linoleum to be placed on the floor SUNDRY PROCEEDINGS Francis Fritsch and eight others protested = pro-tested against the action of the council I revoking the proposed change of grade I qn Main street for a distance of 320 I feet north of First North street The I protest was referred to the street committee = I com-mittee The matter of continuing the employment em-ployment of John James to prosecute suits against delinquent poll taxpayers was referred to the street committee I with
