Valley railroad by refusing re-fusing to grant a writ of mandate compelling the trustees of Fresno to sell a franchise for the road through the city of Fresno without going through the process of receiving bids at auction as reauired by a provision of the DOlitioal code of California The railroad wanted to buy the franchise outright and so asked for a writ of mandate which has been denied This decision may be provocative of some trouble for other towns and cities along the proposed line of route may follow Fresnos examle and the projected pro-jected enterprise be hampered by many delays im-portation of Ice by the latter for the use of its employes The person who enjoys the ice monopoly here contends that the railway company has no right to sell or import ice He invoked the law and three railroad offlcias were subpoenaed to testify tes-tify in support of his complaint before the alcade who ordered the confiscation of the companys ice I will be seized at once There is much excitement over the matter The general belief is that the United States of Colombias contract with I the railway company gives the latter unlimited un-limited power of Importation This act I of
