were treated to a performance i perform-ance seldom witnessed in 3 body working I work-ing under parliamentary rules The Republican members made a desperate I effort to usurp the power of the chair Ito I-to appoint all standing committees by claiming that the action at the last acton meeting in plain violation of the < rules I appointing a committee of three to se lect l all standing committees was legal and proper That action mecessltated a suspension of the rules which according ac-cording to all parliamentary authorities authori-ties cannot be done without giving at least one weeks notice but that did not deter the Republicans from claiming claim-ing that in suspending the rules without with-out notice they acted in a perfectly legal le-gal manner As the matter now rests the president has appointed his committees but the communication announcing them has been tabled by the Republican major ity Pending this the Republicans took no steps to exercise the power of appointing all standing committees which they claim to have vested in the committee of three appointed at the previous meeting But the fight is on and as long a the Republican mem hers have a shadow of a leg for support sup-port the friction between them and the president will continue while the taxpayers payers suffer As at the former meeting OMeara le the Republican forces in the fight last night and he at least claimed a substantial over victory when the circus was oveNEWELL NEWELL ASSERTS HIMSELF As soon a the roll had been called President Newell announced that the action taken at the former meeting of the board in the matter of appointing apointng a committee of three to appoint all standing committee in the council was clearly a violation of the rules under which the body was working He declared de-clared that the rules required that one weeks notice be given in order to abrogate or suspend any rule there fore he declared the action entirely out of order COMMITTEES ANNOUNCED OMeara ruling of the presiding officer was accompanied by a loud rap of the gavel But Mr OMeara remained standing and continued in a most emphatic vein I appeal from your decision Mr President and if you dont recognize I me I will put a motion to the clerk I and have you removed which I can do under the rules I The chair rapped loudly to order and amid the protests from the Republican can members ordered the minutes read This done Councilman Morris moved to expunge from the records all that portion referring to the action taken at the previous meeting usurping the power of the president to appoint all standing committees The motion however was promptly voted down iy a strict party vote to 9 CALLED TO ORDER Stewart then renewed OMearas motion mo-tion to table the presidents communication communi-cation announcing the committees but i met with a similar fate the chair ruling it out of order I This apparently angered OMeara who jumped to his feet and launched into a vigorous denunciation of the chair declaring his rulings arbitrary He defied any attempt on the part of the president to overrule the majority and began to put a motion appealing from the decision when the chair repeatedly re-peatedly called him to take his seatO seat-O 1eara remained standing and a long wrangle between the two ensued which ended in the latter taking his seat and the regular order of reading petitions peti-tions and communications taken up When this order had been finished OMeara moved that all communications communica-tions be laid on the table Dale rose to a point of order claimIng c ing the communications had been referred re-ferred by the president to their proper I pro-per committees and was sustained by the chair APPOINTMENTS CONFIRMED The following appointments were then announced and confirmed George A Davis deputy dog tax collector P O Perkins deputy special tax collector Albert Reiser clerk in recordersoffice recorders of e ASSISTANT ATTORNEY A communication < f rom f < City Attorney I 1 = McKay announcing the appointment of David Hempstead as assistant city attorney at-torney caused some discussion Diehl moved to confirm but Collister report for the month of December showing the amount of fines assessed during the month to be 189450 of which 834 had been paid in labor Referred The Salt Lake and Ogden Gas and Electric Light company presented a bill of 225505 for lighting the streets during the month of December Laid over MR LLOYD PROTESTS ExCouncilman B T Lloyd sent up a communication informing the body that he still claimed to be the legal successor of J M Watson deceased and protesting against William Elliott taking any part in the proceedings Placed on file The December report of the superintendent superin-tendent of the waterworks department was placed on file I showed the expenses I ex-penses to have been t297940 FIRE DEPARTMENT I The report of the fire department for the past year showing the expenses to have been 53259113 which included the purchase of hose at a cost of 1280 improvement at house No 2 300 and the purchase of department horses costing about 340 The department responded to 140 alarms against 120 during the previous year and extinguished fires on property prop-erty valued at 1840588 carrying 968 760 insurance The total insurance loss was 8652841 and total fire loss for the year insured and uninsured was 99 81641 though of this 8000 was outside j the city limits I The board with agrees the chief that I the Fourth precinct station should be I erected without delay The Old House at presented the annual report of the police department pOlce com mending the actions of the policemen pOlcemen in responding to the calls of their su perior officers for extra duty on days requiring additional force which has heretofore been allotted to specials The protest of last year is renewed regarding re-garding the deplorable condition of the jail and its unsafely to hold bad crim inals The board recommended the employment of a matron at the earliest earli-est possible date earl The estimated cost of operating the department for the ensuing year Is placed at 50370 including the chiefs salary which i is recommended beset be-set aside to the credit of the board at the beginning of the fiscal year and whatever remains at the end of the year be turned back into the treasury This Then I ask that the presidents communication com-munication referring to the appointment appoint-ment of committees be read as it was not read in its proper order said OMeara I was promptly declared out of order or-der inasmuch as there were no objections ob-jections raised when the communication communica-tion was read GRAVITY SEWER APPROPRIATION The report of the committee of the whole on the consideration of the final estimate of 3100131 on the gravity sewer which had been placed on a special spe-cial appropriation list by the old council coun-cil and subsequently vetoed by Mayor Glendinning was then read the committee com-mittee asking for more time in which to consider the matter I was evident that some one had experienced ex-perienced a change of heart a it was promptly moved to table the report and proceed to take a vote on the passage of the special appropriation over the mayors veto This met with some objections ob-jections from Stewart Dale and others oth-ers Councilman Romney took the floor and made an urgent plea to pass the appropriation over the mayors veto The claims had been presented several months ago and it was an injustice to the contractors he said to defer acton I ac-ton any longer Mr Dale wanted more time as now I he would be forced to vote to sustain the mayors veto Councilman Le Prohon thought the word of the board of public works might be taken as sufficient How about the mayors word suggested Mr Dale An amicable settlement was effected by the appointment of a committee consisting of Messrs Romney Dale Allen Hayward and Mulv y to which the matter was referred with request that a report be returned at the next meeting ot the council THE STORM BREAKS I looked as though the scrapping was over but this was only the calm that wanted to know by what rule the city attorney had a right to speak Ion I-on a question of parliamentary law This was followed by a motion from OMeara that the attorney be not allowed al-lowed to speak Out of order promptly declared the chair but a moment later reconsidered this motion It ruling and put the moton I carrie by a viva voce vote but division di-vision was called for and eight Republicans Re-publicans rose to their feet and voted against the attorney being allowed to speak OMeara then renewed his motion to take the presidents communication up for consideration OMEARA RUNS THE COUNCIL I was declared out of order but OMeara held the floor appealed from the decision of the chair put the question ques-tion of appeal which resulted in the cnair not oeing sustained After this the Republicans had everything every-thing their own way OMeara put the original motion and amid protests from the chair it was carried by a strict party vote A motion by Stewart to lay the communication on the table followed fol-lowed I was declared out of order but the chair was not sustained and OMeara put the original motion from the floor of the house and the communication commu-nication was tabled by a strict party vote The only matter of business transacted transact-ed after this was the appointment of a special committee of threeconsisting of Councilmen Romney Buckle and Dale to which the city auditors communication communica-tion in regard to the payment of 1561 45 due the Union Pacific for some lands in Emigration canyon was referred Adjournment was taken for
