Show IASIGFS TROUBLES Several Fine Points of Law Involved in the Case New York Feb 19 Turkish Consul Joseph A lasigi accused of embezzlement embezzle-ment in connection with his trusteeship of certain estates and awaiting extradition dition to Boston was before Judge Ad i dison Brown of the United States district I dis-trict court today on a writ of habeas corpus The petition for the writ was made by Consul lasigi who claims his detention is in violation of the const tution of the United States and of the treatv of 1S30 between the government of the United States and the government I govern-ment of his imperial majesty the sultan sul-tan of the Ottoman empire The petition goes on to say that Iasigi is held in custody wholly without authority au-thority or Jurisdiction by reason of the fact that he as consulgeneral is I subject only to federal Jurisdiction The consul says that he Is charged with having committed in the commonwealth common-wealth of Massachusetts on the 1st of July 1S92 the crime of embezzlement while agent for Pierre Charles Derleux of about 8000 but that several years have elapsed since the alleged embezzlement embez-zlement and yet he has never been indicted in-dicted by a grand Jury nor is there any proof that he is a fugitive from Justice On the other hand I is claimed that subdivision 8 of section 711 of the revised re-vised statutes under which the consul claims to be amenable only to federal Jurisdiction was repealed in 1S74 At I the hearing today counsel for lasigi J said the question before the court is I whether the state courts Ijad Juris r lad diction I > I After Judge Brown had heard the ar I I = < < < Kuments on both sides counsel were i gments both r given briefs until In the Wednesday case next to submit I |
