Business Busi-ness Commissioners Varian and Noble scored a significant victory at the meeting of the fire and police board last night and as a result the chiefs of the two departments have been shorn of all power to discharge al subordinates for any offense without first preferring charges to the board except incase in-case of conviction for a crime in any court when the chiefs may dismiss the offender Thus the deadlock that has existed in the board for weeks past has been broken and the way it came to pass was about as follows Jennings who has stood by Cohn all through the fight was absent He is somewhere in the Deep Creek country Both were in favor of giving the chiefs power to dismiss at will holding hold-ing that the new law intended that the chiefs should be vested with such power Chairman Varian and Commissioner Noble put another construction on the law contending that the chiefs have power to dismiss only under such rules a the board may establish Thus the board was evenly divided on the proposition The opportune time came last night when Jennings was absent After the transaction of some routine business Noble offered the following set of rules and followed It up by moving their adoption RULES AS ADOPTED Rules defining offenses a nd prescribing penalties therefor to b imposed by the chiefs of the police and fire departments I is ordered by the board of police and fire commissioners that the following rules and regulations be aid they are hereby established pursuant to direction of section 10 of an act of the legislature of the state of Utah approved March 30 1896 entitled An act providing for the appointment and duties of the board of police and fire commissioners etc for the government of the chief of police and chief engineer of the fire department for Salt Lake city I Rule IThe chief of police and chief engineer respectively for any violation of any rule of discipline made by him by authority of law for the securing of discipline in his department may impose a fine of a sum not exceeding 5 upon any officer or member or employee violating I such rule for the first offense Rule 2For the second or any subsequent I subse-quent violation of the same rule or rules as mentioned in rule 1 such chief may in his discretion impose a fine of a sum not exceeding 1 or may suspend the offender without pay for a period not exceeding 30 days Rule 3Cpon conviction of crime in any court having jurisdictionof any subordinate subordin-ate officer or member the chief may dismiss dis-miss the offender Rule 4The foregoingnrules do not apply ap-ply to the captain of police or the assistant as-sistant engineer Rule 3For 5 all other offenses involving involv-ing moral turpitude or winch are prejudicial prejudi-cial to the discipline good order or welfare wel-fare of either department not embraced within the foregoing rules the respective chiefs shall prefer charges to the board against the offender when proceedings shall be taken as provided by section 11 of the act in rule 1 cited COHN OBJECTS Chairman Varian seconded Nobles motion to adopt Cohn realizing that he was caught interposed in-terposed an objection to uch haste He called the members attention to the fact that the rules proposed by him some weeks ago did not receive prompt action and he further intimated that it was tak intmated ta ing an undue advantage of his side in the absence of Jennings He then produced the arguments he so often has used to sustain his position Chairman Varian said I made no difference dif-ference whether Jennings was there or not the other side was doing its duty as thev saw i Cohn wanted to know if i was the purpose pur-pose of the proposed niles to take the power of dismissal entirely out of the hands of the chiefs Well what do you suppose this board is for queried Noble Cohn again took up his old arguments citing from the law but he began to realize that he was defeated and started for the door His object in doing so was obvious for had he gained the door 3 quorum would have been lacking and no further business busi-ness could have been transacted VARIAN EQUAL TO THE OCCASION Mr Varian however was equal to the occasion and before Cohn got to the door he called for a vote on the adoption of the rules Varian and Noble voted affirmatively and just as Cohn reached for the door knob the chair announced the rules adopted Cohn however proceeded across the hall to Chief Pratts office There was some further business to transact and Clerk Felt had to go and call him back CHIEF PRATT CALLED DOWN Chief Pratt came in for some criticism for sending Captain Donovan and Officer Janney into Idaho on a search for Her mans Varian brought it up and wanted to know from the chief if he had made 00 ffuleuhad any n pun 10 me commission giving reasons for his action Chief Pratt said he had not except verbally to some members of the commission com-mission The chair then said he did not think it was within the scope of the chief to send men off his force into other states Such action was entirely unauthorized The chief agreed with Mr Varian that it was not good business but it had been customary at times before I it was not right he wanted to know i He also added that in this case there was no expense to be borne pense by the city Noble thought a rule prohibiting the chief from sending out officers on such missions had been passed last year Clerk Felt however could not find any such rule Varian said he desired to go on record as emphatically opposed to such business and suggested the proper thing to do would be to call the officers back and have a resolution spread on the minutes to that effect The patrolmen were employed em-ployed to do duty in the city and the work of the department did not extend beyond that I was a case for the county coun-ty and not for the city He desired it distinctly understood however that he I did not question the motive in Sending these men away but is was a bad rule to establish I Cohn said it was an extraordinary case He had given the chief his consent but would favor adopting a rule prohibiting such doings in the future The matter was then referred to the committee on rules to report a proper resolution ing for adoption at the next meet SILAS SMITH DESK SERGEANT The appointment of Silas T Smith as desk sergeant was confirmed Chief Pratt transmitted to the board the resignation of Officer Yocum and i was accepte He also sent in a communication commu-nication announcing the appointment of exOfficer If E Pack to take Yocum but this Under the rules I place unde ruie was laId over for one week The chief asked that he be permitted to place Pack on the force temporarily until theboard should act on the appointment and this was allowed MISCELLANEOUS BUSINESS Bills amounting to 263620 for the police department 498 35 for the prison department depart-ment and 181225 for the fire department were allowed A petition was received from th Western West-ern Hardware company and several others oth-ers protesting against conferring special police power on persons not regularly members of the police department and receiving re-ceiving their pay from the city The communication is especially directed direct-ed at the proposition of the League of American Wheelmen to pay the salary of a bicycle policeman to be selected by the club city and given police authority bY the C N Butler chief consul of the wheelmen men sent in a letter saying that the offi cers of the club had never authorize any one to make any such proposition as j the selection and the paying of a salary of a special policeman payng chief of po ice and therefore the matter should note > not-e even considered by the department The rules governing the qualifications of applicants for positions on the police farce were amended so as to make the minimum height for desk sergeants five feet six inches and the minimum weight 1EQ pounds The board then adjourned for two
