Show j 1HIR DISTRICT COURT The Criminal Calendar Is Begun Before Judge Zane YOLTJNTARYMANSLAUGHTEE Is the Charge Against Thomas ONeill ti of Park City t rIte Salt Lake Building and Loan Association r Asso-ciation Case Logan and Sirs Niolson Get a Light Sentence Alleged f Fraudulent Transfer o Property The criminal calendar was taken UD r yesterday morning in the Third district 1 court before Chief Justice Zane A few 1 motions were heard as a starter the first being that of Attorney E W Tatlock Who appeared In the case of Joseph C I Davis vs The Salt Lake Building and Loan association and moved for an order Ion I-on the defendants calling upon them to produce all the books of the association I and to deposit the same with the clerk of the court until after the trial of the case r also that the plaintiff and his attorney attor-ney be permitted to examine the f books at any and all reasonable times The attorney submitted an affidavit by r t the plaintiff in support of the application r His honor Judge Zane set the hearing t on the motion for this morning r Olr John Zane Explains i Subsequently Attorney John M Zane arose and saidI desire to state to the court that at the time the complaint in this action was filed my name was appended ap-pended to it as one of the attorneys for the t plaintiff Afterwards I wrote a letter to I the clerk of this court telling him to cancel can-cel the appearanceif there was one made in my behalf because the signature to the complaint was not authorized I ascertained as-certained afterwards however that the client whom I represente had told Mr Tatlock who is the attorney for the plaintiff plain-tiff to also append my name and the matter coming on as it has a great injustice injus-tice has been done to Mr Tatlock and one under which he should not remain He supposed that the request of the plaintiff plain-tiff was sufficient authority for attaching j my signature I desire to make that statement simply because the letter which I sent to the clerk has already appeared in the public prints and Mr Tatlock has been placed in a false position thereby |
