sequel to the deplorable Irvine tragedy at Lincoln Neb the particulars of which are still fresh in the memory of the public was the institution of divorce proceedings by Mr Irvine in the Third I district court yesterday Tho complaint is quite short and after stating that tho parties were married on June 20 1853 it IB alleged that the defendant defend-ant committed adultry with Charles E Montgomery in or about Lincoln Neb in ISSJ and In Chicago on or about February 24 1892 Upon these grounds Mr Irvine prays for a decree of divorce that hia wife may be debarred from any claim or title to his property and for the custody of his I daughter Flossie aged 7 years ANOTHER MATRIMOSIAL WRECK Mary Ann Hammond filed an action for divorce against William Hammond in the Third district court yesterday The plaintiff allege that tha defendant has continually con-tinually treated her in a cruel and inhuman in-human manner and upon a certain occasion occas-ion threatened to kill her and attacked her with a butcher Knife The complaint is filled with allegations of similar character and according to Mrs Hammonds story her voyage upon the matrimonial pond has been a stormy one In addition to a decree de-cree of divorce the plaintiff also desires thecustody of seven minor childron and that tno defendant be restrained from disposing dis-posing of or occupying the property held in common pending a settlement of the suit and division of the property It has only been a short time since Hammond Ham-mond was tried in Commissioner Moyers oourt upon a charge of beating his wife He was found guilty and fined 550 which he paid Hammond is an invalid and cannot walk without the aid of crutches The Tweuty Thousand Dollar Case The case of tho American Publishing company vs the A Fisher Brewing company com-pany was resumed In the Third distaict court yesterday morning and continued all day The plaintiffs got all their testimony in soon after noon and the defense then asked the privilege of amending their answer an-swer This request was vigorously opposed op-posed by the plaintiffs but Judge Zane allowed the amendment to be made The amended answer alleges additional fraud with reference to the prices charged for portions of the work debarred and permits tbe defendants to offer testimony showing that tho prices set out in the original proposition pro-position were much too high The examination of witnesses for the defense de-fense then began and continued until the adjournment hour It is doubtful whether or nbt the case will reach the jury Monday Short Orders I R M arraigned yesterday for forging a timecheck on E E Rich of the Peoples Forwarding company and entered a plea of not guilty The alleged crime was committed October 16 the amount was S17 and Mellis IB IS years of age His bond pending a hearing was fixed at 300 Wilson Gets Two Months Frank Wilson who was indicted by the late grand jury upon the charge of assault with intent to do great bodily harm upon the person of one John Doud at Bingham on September 17 was arraigned yesterday Owing to the fact that the complaining witness did not desire to prosecute the case I further Wilson was allowed to plead guilty Ito I-to battery and was sentenced to two months imprisonment In the county jail T1e assault took piace during a drunken row Threatened to Kill His Wife Larned Cottrell who was arrested at avery a-very late hour Friday night on the charge of mistreating his wife went before Commissioner Com-missioner Graenman yesterday and gave Kinds in the sum of 500 for his appearance appear-ance Mrs Cottrell is the complaining witness and she charges her husband with threatening to kill her on November 29 He I I also drove her out of his house at a late hour on Friday night and she immediately wont to Commissioner Greenmans residence resi-dence and asked him to issue a warrant for her husbands arrest There is also a second charge against tho defendant in which he is accused of bat tory upon tho person of C A Kane his brotherInlaw Cottrell vas formerly in the implement business and baa the repu tation qf being a good citizen During the past fow years though he has had no permanent per-manent employment and has drank to excess ex-cess at times Upon such occasions ho becomes be-comes violent ana it is then that he gets within the jurisdiction of the law governing govern-ing certain offenses Divorce proceedings instituted by his wife are also pending in the Third district court |
