Show Millers Unworthiness I As intimated in the Herald some few days ago the Sandford incident in Utah is likely to not only leave an indelible blot upon Mr Harrisons administration but its it-s also probable that it may affect the selection lection of AttorneyGeneral Miller for the vacancy on the supreme bench The New York Times notes this in the subjoined excerpt It is not forgotten that AttorneyGen eral Miller has been spoken of in the Pres idents home paper theutterances of which are taken as semiofficial on many matters as likely to be nominated to the vacant place on the supreme court bench How will the nomination strike the lawyers of the Senate in the light of the letter explaining explain-ing to Judge Sandford his removal in order to make a place for a man who can be de > ended on to carry out policy from the bench The suggestion that the President can properly dictate a policy for the supreme su-preme court of Utah may be followed before be-fore long by the appointment of somebody who will consent to the dictation of a policy for the supreme court of the United States If the President may dictate policy for the Utah court there docs not seem to bean be-an good reason why he should not run the supreme court at Washington to carry out a more extensive policy The question is the same and it would appear that if he has any policy he wishes to impose on the supreme court he could not do better than to appoint Mr Miller to fill Judge Mat thews place as he has so acquiesced ac-quiesced in the Presidents dictation of a policy for the chief u itice in Utah The chances are that in the face of the outburst of indignation which is demanding demand-ing the retirement of Miller from tho cab net on the ground that a man who would write such a letter as he did Judjre Sand ford is an unsafe man at the head of the nations law department President Harrison Har-rison will scarcely dare to select him for a place in tho highest tribunal But should he unblushingly face the public and name Miller for supreme judge there is apt to be an exciting time in the Senate nThere arc some independent conscientious men among tho Republican members of that part men who would not hesitate in the cause of a pure judiciary to refuse to confirm con-firm such a creature as Miller Harrison himself with his peculiar idea of a policy for judiciary would not be so dangerous a man on the bench as one who would be subservient in his actions to the executive power in tho manner portrayed by Miller Omaha here W |
