Tedious Work of Selecting Jury ia Now Going Forward. Boise, Idaho. Substantial progress toward the formation of a Jury to try William D. Haywood for the alleged murder of Frank Steunenberg, twice chosen as the chief executive of this state, was made on Tuesday, the third day of the trial. Selection of talesmen halted for three solid hours over chairs five and six, but once those seats had been filled progress was very rapid. At adjournment for the day counsel for the defense had the examination and temporarily passed the tenth talesman. The couit room Is filled at all times, hut the crowd Is a changing one. There were more women present than on any other day, but at that the number scarcely exceeded a dozen. Mrs. Steeve Adams came again on Tuesday, and this time to a seat beside Mrs. Haywood Inside the railed enclosure. She remained with the Invalid woman all afternoon and assisted in taking her from the room after adjournment, She and her husband are down as witnesses for the state, but her action Is taken as a clear indication of her attitude. Tho United States supreme court, In Its decision In case, rendered on Monday, intimated rather strongly that the national reclamation act, under which the federal government Is spending upward of 30,000,000, may be unconstitutional It Is not so held In specific terms, but the opinion of the court Indicates that the constitutionality of this act Is in question, and It would not be surprising if private interests which are interfered with by government projects should bring suit to restrain the government from diverting water for irrigation purposes. There Is already one such suit pending, brought by former Senator Turner of Washington, on behalf of an Arizona company that wants to restrain government work on the Colorado river so that they can use the water to reclaim lands in California. It Is entirely probable the Twin Falls company In Idaho may bring suit in the light of this decision, for there la a prospect of a conflict between the government and private enterprise along the Snake river. In rendering the decision in the Kansas-Colorad- o case. Justice Brewer on behalf of the court declared that congress can only legislate In to such matters as are spodflcally enumerated In the constitution, and that power to legislate with respect to Irrigation of arid lands was not one of the enumerated powers granted bj the constitution.
