the peace and with having carried concealed weapons he was fined 5 on each charge and the costs of the suit were charged against him making a total of the charges against mr funston grew out ol 01 the wrecking with dynamite by a temperance fanatic on july 10 ol 01 ahrea lola joints or saloons the explosions followed an agitation against the saloons in which governor hoch was appealed to in an effort to secure the enforcement of the state prohibition law intense excitement cit followed the act of the dynamiter na miter and jor three days the city va crowded with people who came from many points of the state to lw l w the wreckage caused and to join in a hunt tor the dynamiter during the height of the excitement mr funston it was charged had made inflammatory flam matory utterances to crowds that gathered about him on the streets patrolman cannon tried to fsr gnade mr bunston to desist a quarrel between the two ensued and funston it was alleged attempted to draw a revolver funston was arrested and a formal charge made against him after which he was released upon his own recognizance at the trial which was attended ly hundreds of persons one witness testified that mr funston had said 1 I am glad that some one had nerve enough to do it the only regret is that the men saloon keepers were not there to be blown out of their buildings if the police officers had dons their duly this would nol havo happened I 1 have no sorrow in my heart for the men along this street nho n ho have suffered loss because bey have done business with these men and haw not put a stop to the saloon business patrolman cannon testified that mr feaston had threatened his life and had cursed him a lie interrupted the defendant fen dant mr funston testified in his own defense he admitted he had come to two armed with a shotgun and haa purchased shot on that da ho asserted that be wanted the shot to protect his property located some distance out from 1 lola against a threat that had been made to and hundreds of men have searched for him judge adair in sentencing mr funston said it is with great regret that I 1 have been called upon to render judgment la the matter while this Is not a matter of testimony I 1 wish to stata that I 1 have known mr funston ever eunce I 1 have been in kansas that I 1 him to be an honorable upright citizen and a man of exemplary character and reputation I 1 heartily sympathize with his feelings in regard to the joint question A man who regards his family and children would naturally resent anything which would tend to disgrace or injure them I 1 do not wish it understood that any judgment I 1 may render intimates that I 1 do not sympathize with the sentiments and feelings of those who believe in the enforcement of the prohibitory law I 1 have decided the matter disregarding the standing of the defendant public sentiment and everything except the law and the evidence continuing judge adair said that the testimony showed that the defend ant came to town with guns and bought ammunition that he made loud utterances before several crowds that gathered about him on the streets find that his language langu aga addressed to patrolman cannon was insulting mr funston was not in court when the decision was rendered his attorney immediately filed an appeal to the district court there were but few persons in the court room at the time and there was no show 0 a demonstration on later mr who had come into town from his country residence res dence said that he bad not expected a favorable decision and was therefore sot disappointed in discussing the result of hi trial mr funston said there is not a citizen of kansas who believes that I 1 am guilty of disturbing the peace we shall win out la the district court to which we hava appealed the case 1 I have received letters from all over kansas expressing sympathy and the belief that I 1 am innocent not one ot these letters but has contained tho most cordial expressions of sympathy aid the hope that I 1 may win out the people arc waking up the dynamiting of the lola saloons was most deplorable but at the same time t will answer a good in stirring the people of kansas to action it will call attention anew to the fact that these same conditions exist in almost every kansas town the prohibition law will be enforced the time is coming soon we lust not leave it to a few preachers and enthusiasts or the thing will drop here the bone and sinew the alid men of the country must take part the lime will come when a mem ter of the legislature will have to declare himself he will have to say whether he favors strengthening the law and he will not be elected if be does not the law should be amended fa that a saloon keeper who persists in the violation of the law should bo
