Lake, was brought back from Pueblo, Colo, by a deputy shelrff of Salt Lake county, was arraigned Friday after-I after-I noon before Justice of the Peace I Charles Holm of Murray, on a charge I of adultery. Lane's"tionds were fixed at $1000, in default of which he remains re-mains In. the county jail. There are several peculiar features in the case. Count v Attorney Job P. Lyon Is authority for the statement I that he refused to Issue a complaint upon the charge of adultery when the I case was laid before him. as there I was no direct evidence that Lane I was a married man. It is reported j that Lane's wife was on thc road from Chicago to proseeute him, but the sheriff s force declin'd to give any definite Information on this point. Unusual Procedure. The complaint charging line with adultery was prepared In the office of District Attorney F. C. Lnofbourow who admitted that this was not thc usual procedure, but explained the action ac-tion by saying that the county attorney's attor-ney's office was confused owing to the change which takes place n the first of the year. Justice Holm could not remember who swore to the complaint, and none of th sheriffs force who could o reached at 1ft o'clock Friday night knew anything about the complaining witness Justice Holm merlv said that Lane, who had no attorney present, pres-ent, waived preliminary hearing jnd was bound over to the district court. No charge ha.? been placed against the girl, who was not detained in custody. |
