Show 1nnIGATIO AXD TTATEII RIGHTS The following article has been proposed pro-posed to be incorporated in the Constitution 1 Con-stitution of the State of Utah under I the title of Irrigation and Water Bights It has been prepared by the Irrigation Commission of which Hon 1 t L W Shurtliff is chairman and The Herald has been requested to make t ome comment upon it Section 1 The water of all natural f streams springs lakes and collections of still water within the boundaries of the state are hereby declared to be the property of the state Section 2 There shall be constituted a board of control to be composed of the state engineer and superintendents of the water divisions not more than y half of which board shall be of one political party Whenever a member I I of the board becomes a candidate for political preferment he hall at once be disqualified to hold his office in tl e Board of Control This board fchall under such regulations as may be prescribed pre-scribed by law nave the supervision of the waters of the state and of their I appropriation distribution and diversion I diver-sion and of the various officers connected con-nected therewith Its decisions to be subject to review by the courts of the slate Section a > Priority of appropriation for beneficial uses hall give thebet tel right No appropriation shall be ilenied except when such denial is demanded by public interests The right of eminent domain shall extend to land and water rights Section 4 The legislature shall bylaw by-law divide the state into three 3 water divisions and provide for the appointment ap-pointment of superintendents thereof Section 5 There shall be a state engineer who shall be appointed by the governor of the state and confirmed con-firmed by the Senate he shall hold his office for the term of four 4 years or until his successor shall have been appointed and shall have qualified He shall be president of the Board of Control I Con-trol and shall have general supervision supervis-ion of the waters of the state and of the officers connected with its distribution dis-tribution No person shall be appointed to this position who has not such theoretical knowledge and practical experience and skill as shall fit him for the position 3he salary of the state engineer shall be fixed by law The Herald approves of the first third and fourth sections of the article arti-cle but is of the opinion that the other two sections are not necessary In the organic act but should toe left to the legislature which should be authorized and required to make such provisions in addition to those In section four as are necessary to carry out the purpose pur-pose and Intent of the article Irrigation water rights and the control con-trol of the water supply In the state are matters of the utmost importance and some such provisions s those in Ute sections which we endorse ought to become part of the Utah state constitution con-stitution But as little legislation as possible should be undertaken in that instrument Let the legislature have its proper work to do Irrigation ofii f eclS and regulation should in out opinion be left to the lawmaking > Se j artsxeat oC the state I f t 0 f > f 1Ilr |
