(Superintendent of Public Instruction.) Be It resolved by the Legislature of the State of Utah, two-thirds of all the members mem-bers elected to each house concurring therein : . SECTION I. That it is proposed to amend Section 1, of Article VII, of the Constitution of the State of Utah as follows fol-lows : SECTION I. The Executive Department ahull consint of Governor, Secretary of Stale, Slute Auditor. Stnte Treasurer and Attorney-Cenernl, each of whom shall hold his office for four years, bpfiinninpr on the first Monday of January next after hm election, except that the terms of offiet of those elected ot tho first election shaM begin when the state shall be admitted into tho Union, and shall end on the first Monday Mon-day in January, A. D. 1001. The officers of the Executive Department, during their terms of office, shall reside at the Beat of government, where they shall keep the public pub-lic records, books and papers. They shall perform such duties as are prescribed by this Constitution and as may ba prescribed by law. SECTION 2. The Secretary of State Is hereby directed to submit this proposed nmndment to the electors of the state at the next general election in the manner provided by law. SECTION 3. If adopted by the electors of the state, this amendment shall take effect ef-fect the first day of January next succeeding succeed-ing a determination by the Board of State Canvassers of the result of the election designated In Section 2 hereof. Constitutional Amendment No. 2 A Joint Resolution Proposing an Amendment Amend-ment to Section 10, of Article VII, of the Constitution Relating to Governor's Appointive Ap-pointive Power and the Filling ef Vacancies Va-cancies In Certain Offices. (Superintendent (Superin-tendent of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of ail the members elected to each house concurring concur-ring therein : SECTION 1. That it is proposed to mend Section 10, of Article VII, of the Constitution of the State at Utah, as follows fol-lows : SECTION 10. The Governor shall nominate, nom-inate, and by and with the consent of the Senate, appoint all State and district officers offi-cers whose offices are established by this Constitution, or which may be created by law, and whose appointment or election is not otherwise provided for. If, during the recess of the Senate, a vacancy occur in any State or district office, the Governor hall appoint some fit person to discharge the duties thereof until the next meeting of the Senate, when he shall nominate some person to fill such office. If the office of justice of the supreme or district court, Secretary of State, State Auditor, State Treasurer, or Attorney-General be vacated by death, resignation or otherwise, it shall be the duty of the Governor to fill the same by appointment, and the appointee .shall hold hia office until his successor shall be elected and qualified, as may be by law provided. (Superintendent of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of all the mem-berg mem-berg elected to each house concurring therein : SECTION 1. That it is proposed to mend Section 8, of Article X, of the Constitution Con-stitution of the State of Utah, as follows: SECTION 8. The general control and aupervision of the Public School System hall be vested in a State Board of Education, Educa-tion, consisting of such persons as the Legislature may provide. SECTION 2. The Secretary of State Is hereby directed to submit this proposed amendment to the electors of the state at the next general election in the manner provided by law. SECTION 3. If adopted by the electors of the state, this amendment shall take effect ef-fect the first day of January next succeeding suc-ceeding a determination by the Board of State Canvassers of the result of the election elec-tion designated in Section 2 hereof. Constitutional Amendment No. 4 A Joint Resolution Proposing an Amendment Amend-ment to Section 18, Article XII of the Constitution of the State of Utah, Relating Relat-ing to Liability of Stockholders of Banks. Be it resolved by the Legislature of the State of Utah, two-thirds of all the members mem-bers elected to each of the two houses Toting in favor thereof: SECTION 1. That it is proposed to mend Section IS, Article XII, of the Constitution Con-stitution of the State of Utah, so that the ame will read as follows: SECTION 18. The Legislature may pro- Tide by law that the stockholders in every corporation organized for banking purposes, pur-poses, or the holders of any one or more of the classes of stock issued by any such corporation, in addition to the amount of capital stock' subscribed and fully paid by them, shall be individually responsible for an additional amount not exceeding the amount of their stock in such corporation, or thi amount of their stock of any parti- cular c.um in such un paraffin, for all tU dehtu and liabilities of every V ud. Constitutional Amendment No. 5 A Joint Renolution Proposing to Amend Article XIII, Secti.n 2 of the Constitution Constitu-tion of the .tale of Utah, at Amended at the General Election in 1030 Relating to Tnxalim. of Tangible Property, Ascertainment Ascer-tainment of Value. Exemptions, and the Annual fax for the State. Be it resolved by tho Legislature of th State of Utah, two-thirds of all members elrcted to acli House and two-thirds of all members of each Huuac concurring therein : SECTION 1. That it is proposed to amend Article XIII, Section 2 of the Constitution Con-stitution of the State of Utah, as amended at the general election in 1930, to read as follows : SECTION 2. All tangible property in the SLate, not exempt under the laws of the United States, or under this constitution, shall be taxed in proportion to its value, to be ascertained as provided by law. The property of the United States, of the State, counties, cities, towns, school districts, municipal mu-nicipal corporations ajid public libraries, lots with the buildings thereon used exclusively exclu-sively for either religious worship or charitable char-itable purposes, and places of burial not held or used for private or corporate benefit, bene-fit, shall be exempt from taxation. Water rights, ditches, canals, reservoirs, power plants, pumping plants, transmission lines, pipes and flumes owned and used by individuals indi-viduals or corporations for irrigating lands within the state owned by Buch individuals or corporations, or the individual member thereof, shall not be separately taxed M long as they shall be owned and used exclusively ex-clusively for such purposes. Power plants, power transmission lines and other property proper-ty used for generating and delivering electrical elec-trical power, a portion of which is used for furnishing power for pumping water for irrigation purposes on lands in the State of Utah, may be exempted from taxation taxa-tion to the extent that such property la used for such purposes. These exemptions shall accrue to the benefit of the users of water so pumped under such regulations as the legislature may prescribe. The taxes of the indigent poor may be remitted or abated at such times and in such maner as may be provided by law. The legislature may provide for the exemption from taxation taxa-tion of homes, homesteads, and personal property, not to exceed $2,000 in value for homes and homesteads, and $300 for personal per-sonal property. Property not to exceed $3,000 in value, owned by disable ' persons who served in any war in the military service serv-ice of the United States or of the State of Utah and by the unmarried widows and minor orphans of such persons may be exempted ex-empted as the legislature may provide. The legislature shall provide by law for an annual tax sufficient, with other sources of revenue, to defray the estimated ordinary ordin-ary expenses or the state for each fiscal year. For the purpose of paying the state debt, If any there be, the legislature shall provide for levying a tax annually, sufficient suffi-cient to pay the annual interest and to pay the principal of such debt, within twenty years from the finaL- passage of the law creating the debt. The Secretary of State ia hereby directed to submit the proposed amendment contained herein to the elector of the state in the next general election in the manner provided by law. SECTION 3. If adopted by the elector of the state, this amendment shall have effect ef-fect on the first day of January next succeeding suc-ceeding a determination by the Board of State Canvassers of the result of the election elec-tion designated in section 2 hereof. Constitutional Amendment No. 6 A Joint Resolution Proposing to Amend Section 9, Article VI of the Constitution of Utah, Relating to Compensation ef Members of the Legislature. Be it resolved by the Legislature of the State of Utah, two-thirds of all the members mem-bers elected to each of the two honsea voting in favor thereof: SECTION 1. That it is proposed to amend Section 9, Article VI, of the Constitution Con-stitution of the State of Utah, as follows: SECTION 9. The members of the Legislature Legis-lature shall receive such per diem and mileage mile-age as the Legislature may provide, not exceeding ex-ceeding eight dollars per day .ind ten cents per mile for the distance necessarily traveled trav-eled going to and returning from the place of meeting on the most usual route, and they shall receive no other pay or perquisite. per-quisite. SECTION 2. The Secretary of State is hereby directed to submit this proposed amendment to the electors of the state at the next general election in the manner provided by law. SECTION 3. If adopted by the electors of the state, this amendment shall take effect ef-fect the first day of January, 1937. I, M. H. Welling, Secretary of State of the State of Utah, do hereby certify that the foregoing is a full, true and correct copy of the six Constitutional Amendments proposed by the regular session of the legislature leg-islature of 1935 as the same appears of record in my office.
