The Utah Attorney General's Office claimed the customers received only $300 worth of merchandise mer-chandise for their $6,000 investment and that the sales plan was an illegal pyramid scheme. In an out-of-court settlement reached last fall, Feelin' Great was required to change its practices. Judge Ballif, in his guilty verdict, said modifications the company had made since last October had failed to bring it into compliance with state law. 'Under the marketing plan," the judge ruled, 'a person is solicited to purchase 'The Steps to Greatness' in exchange for the right to receive compensation from the introducing of others into the sales plan rather than from the sale of goods, services and other property." He said no reason existed for investing in the company other than a person could sell the motivational program to others and generate an income. Company officials had testified they tried to bring the company into compliance with Utah laws and that they had asked the state to help them make changes. James Barker, prosecuting attorney, said it was not the state's responsibility to tell the company how to comply with Utah law. |
