At an executive execu-tive meeting of the Balllnger-Pinchot investigating committee today a resolution reso-lution was introduced holding that the secretary of the Interior was an unfaithful public officer and should be removed Representative Madison, the Republican Repub-lican Insurgent from Kansas, offered a substitute resolution, holding that the allegations which have been made by Clifford Pinchot and IjOuIs dlavis. a former chief of a field division of the general land office, were sustained. sustain-ed. Representative James of Kentucky offered an amendment to Representative Representa-tive Madison's substitute resolution, providing for the removal of Mr. Ballinger Bal-linger from office and Mr. Madison adopted the amendment. The vote came up on the substitute of Mr. Madison as amended by tho motion of Mr. James and the roll was called. Those voting for the substitute substi-tute were; Fletcher, W. E. Purcell of North Dakota, a Democrat; Representative James M. Graham of Illinois, Democrat; Demo-crat; Representative Madison, a Republican, Re-publican, and Representative James. While this vote was being taken. Senator George Sutherland of Utah, Republican, and Representative Samuel Sam-uel W. McCall of Massachusetts. The Democratic members replied that they had been months considering consider-ing the evidence; that a quorum was present and had a right to transact business. Senutor Nelson took the voting, voting present himself and - then made the ruling that no quorum was present. Mr. James made the point of order that no member had ralse'd the point of no quorum.
