Show CONTINUES TRIAL OF CASE In the civil division of the district court this morning It became necessary neces-sary to continue the trial of the case of John F. Metcraft against the Ogden Og-den Union Depot Railway eompuny which was commenced Friday, a Jury having been called to hear tne facta In tho matter. The reason for tho continuance was that one of tho attorneys for the plaintiff was 111 at homo and could not be In tho court room. The Jury men in the case, and the witnesses, were excused until tomorrow mornl'ig at lit o'clock, at which time. It Is anticipated an-ticipated that tho trial of the case will bo resumed. This is a case wherein the plaintiff is suing for personal damages In the Mum of $25,0i)u alleged to have ac-accrued ac-accrued because of an accident to the plaintiff which caused the amputation of a part of tho left leg. The complaint com-plaint alleges that the plaintiff was employed by the defendant company as an engineer September 11, 190. and that while In the discharge of his duty ho hod occasion to climb over a certain coal gate, and that In doing so ho caught bin left leg on a rusty nail which w-ns protruding through the wood work of the gate. Inflicting In-flicting such Injury that It brcame necessary o amputate a part of the log. The complaint says that the wound in the log caused tuberculosis of tho knee. The case was called Friday and the plaintiff placed upon tho witness stand, hp testifying, substantially, to the facts as set forth In the com plaint. I |
