Show WHY HE REFUSED TO GRANT THE INJUNCTION 1 JUDGE EXPLAINS IN REGARD TO RECALL ELECTION. H Says Recall Section of Charter Provides That Mayor's Successor be Elected by the People. Los Angeles, March 24. In his decision, de-cision, rendered yesterday, rerusing to grant an Injunction to prevent tho ' holding of a recall election to chdoso ' a successor to Mayor Harper, Judge Eordwell sots forth that the theory ot complaints against the recall Is that, by tho resignation of former Mayor Harper, the objects of the recall election elec-tion have been filled, that tho 001m- . ell having appointed a successor to the former major, thoro is no further need for an election, and that the people have no right to name a successor to Harper, slnco the city council already has done so. Judge Bordwell says that It is clearly clear-ly contemplated by the recall section of the charter that the successor ot him, whom the recall proceedings seek to remove from office, shall be elected by the people, and that the court should not lay down a ruling denying this right. Further, he says, the Judicial Ju-dicial must not Interforo with the political po-litical branches of the government. Moreover, any party questioning tne -result of the election has his remedy- I in-law. Therefore the defendant's demurrer to the complaint, in each of the two actions brought, is allowed and tho action ac-tion dismissed.
