Show Stohl Claims That Hendrickson Did Not Keep His Word SALT LAKE. April 10 Lorenzo H. , Stohl was under cross-examination yesterday before Judge W H. Braniel of the Third district court In trial ot the suit brought by the West Cache Sugar company against J. A, Uond-J Uond-J rlck&on and Mr. Stohl. The wltnesB said that Mr Hendrlck-', Hendrlck-', son conducted practically all nogo I nations incident to organization of the sugar company and the turning over to it of contracts for purchase and removal from Canada to Cache valley of the Knight sugar factory. .Mr. Hendrickson. he said, had insist-' insist-' cd on secrecy with regard to the eon-I eon-I tract price with the Lynch-Cannon j Engineering company for moving the i plant, testifying that he suspected : Hendrickson of having cut out from ; tho copy of tho contract which was submitted to 'ho board of directors the page carrying the consideration. Accusation that Mr. Hendrickson had broken his word with him was made by Mr stohl on (he Witness stand. He said that Hendrickson I had promised him, on being admitted to an interest In the option, that they (should sell it to the highest bidder, for location anywhere. He Laid Hendrickson did not keep hla word In this respect, that it was through his insistence it went (o Cache valley. Makes Admission. Mr. Stohl admitted ho told Joseph Featherstone to "go to hell" when Mr. Featherstone upbraided him because he was squeezing Featherstone out of the. enterprise for a sugar factory for Cache valley west of Bear rier. He testified ho was party to a plan, I at the time of endeavor to lnt rest James Plngree of Ogden. whereby; i Hendrickson would have been kicked out of tho enterprise if Mr, Featherstone Feath-erstone should succeed In getting from Mr. Hendrickson the contracts for j 1 beet acreage which had been signed by the farmers of Cache valley with Hendrickson, as agent for the "West I Cache Sugar company, to be incorpor- ated." With regard to Ihe contract where., bv Mr Featherstone a pte-d $1,000 i as settlement for his interest in the promotion profits. Mr. S'dil admit-; tod he wrote his own name Into ihe i contract after Mr. Featherstone had signed It, making tho contract to ap- pear that he was a party to It. Originally Orig-inally It had contained only the name of Mr. Hendrickson as entering Into the contract with Mr. Featherstone. As a witness for the plaintiff, Mr Featherstone testified, some time since, that he discovered the Interlineation Inter-lineation when he receipted 'he contract con-tract after the last of the $1,000 had been paid, and snld that ho drew a line through the interlineation as it j appears in the court exhibit, declaring declar-ing at tho time he would sign no paper to which tho name of Mr Stohl i was attached. lie explained his rea- son for this was the treatment ac-I ac-I corded him by Mr Stohl In squorz-! squorz-! ing him out of the company. Faced With Letter. Mr. Stohl testified he first told Mr. Hendrickson on .November 10. lOlti. 61 having obtained au option on the Knight plant. Faced with a letter dictated by Mr. It. ndrlckSOO in the office of Mr. Pin gree at Ogden on November 6, which referred to the possibility of getting tho Knight plant, he admitted h w as present at the time of the writing ot the letter, but said he did not recall its substance. He admitted he might have told Mr. Featherstono on No- ember 3. in talking by telephone to him at Logan from Salt Lake, of having hav-ing secured the option, but could not remember if he had done so. Asked to Identify a copy of a let ter as being of one received by him from Mr Hendrickson, Mr. Stohl re. marked. "I don't recall receiving it It Bounds very much like Mr Hendrickson. Hendrick-son. I'd hate to deny receiving most any kind of a letter from him." Text of Letter. The text of tho letter, which Mr. Stohl admitted was dictated in Mr. Plngree's office while he was present, but which ho said he did not know tho contents of, is as follows. "November 6, 1916. "Mr James Pingree, Ogden, Utah ' My Dear Mr. Pinpree This will confirm our conversation with you this 1:30 p DO Having secured t, acres of sugar beet contracts In Fach valley for a proposed 'West Cache Sugar company,' with a view of es tablishing a factory west of Dear river near Trenton, and further in view of the fact that the Knight Sugar company com-pany Of Raymond, Canada, desires lo move its factory to Utah. I hereby accept your proposition of an amount of $5,000 for above mentioned contracts con-tracts to be transferred to a company to be organized to remove said factor fac-tor In Canada to a point near Trenton, Tren-ton, Utah. "I wish it understood that the people peo-ple of Cache valley, including myself, may have the privilege of subscrlo-ing subscrlo-ing stock in the factory to an amount not exceeding 200,000. A large portion por-tion of the above amount ha.s already been subscribed, and I would like to have the privilege of allowing these people to retain said subscription.
