Harris' m diviafon of the district court this m morning. District Attorney John C. B Davis stated that a stipulation had B been entered into between himself B and Philbrook's attorney by which the B trial might be continued until April H 17. Mr. Davis stated that State Chem- B 1st Herman Harms was an important B t witness and that he is now in Cali- B ' fornia. It would require a number of B days to bring the witness into court B and it was decided to not take up tho B trial until a later date. B The court took no exception to the B proposed continuance and Jurors in B ' the court room were excused until B April 17. B In the case of the state against W. BBB H. Lightfoot, charged with fraud, the BBB trial was continued until July 7, and BBB the defendant released on his own BBB recognizance. The order was made H on motion of Lightfoot's attorney. B Herbert Riley, who recently -pleaded B guilty to forgery, fras called before BBB Judge Harris, but the court deferred B sentencing the young man unt-il next BBB Friday, stating that further invesli- B gation respecting the nature of the of- B fense would be made. The judge an- B nounced that he was of the opinion BBB ihat a recommendation for leniency B should be made to the state board of II pardons. The defendant forged the name of. J. H.
