Show MUM CASE !S AGAIN CBII1EB OK THE COURT The preliminary hearing of the case of tho stato of Utah vs L. J. Moran was continued yesterday afternoon before be-fore Acting Municipal Judge G. S. Barker. Moran Is charged with complicity com-plicity in tho defrauding of Frank Brown, of Illinois, of $5000 In Ogden about six weeks ago. Yesterday's session was occupied with arguments for the dismissal of the defendant by Attorney George Halverson and the taking of testimony. In moving for dismissal, Attorney Halverson argued that the state had made no connection In its testimony between the defendant and the men who "fleeced" Brown. He also made a motion to have stricken from the record all the testimony of the complaining com-plaining witness, Brown, relating to conversations between tho two men who got the money from him, claiming that tho said conversations did not show in any way that Moran was associated as-sociated with them. Both motions woro denied by the judge and Moran was then put on the stand In his own defense. He testified testifi-ed that ho obtained tho drafts, amounting to nearly $5000, from a man he knew as E. H. Leo, and agreed to cash them on a five per cent commission. com-mission. Ho paid them in installments, install-ments, taking no record, he said. County Attorney Evans cross examined exam-ined tho witness with regard to the checks placed in evidence and, while this was In progress, a continuance wns taken until Wednesday. oo |
