Show iff TUDE LEADS TD AN ENDLESS LAWSUIT A caee of more than usual interest was brought before the municipal court judge this mornins, with H. M. ! Barrows as the defendant. Tho : charge was cruelty to animals and Mr. Barrows entered a plea of not guilty. The witnesses for tho defense de-fense were the defendant and Officer Offi-cer William Reast and those; for the prosecution were Ray Grundy, H L. Lee and Officer C E Iayne. According tc the testimony, Bar- j rows and Lee engaged in a law suit I a couple of months ago over a horse I trade In ".he trade, Barrows was ' bested and he had recourse to the law In order to have the trade rescinded re-scinded He won the suit, and notified Lee to come and get his old horse, but I.e failed to do so. He was then advised by his attorney to take the horse to Lee s place of residence and leave it tied to the fence. He did so and the animal was left there all night. This happened on the night of August 28 and the next morning morn-ing the police were notified that the j horse had been there ail night wlth-I wlth-I out food or water . Sergeant C. E Layne Investigated , the case and tool: the horse to a lo-i lo-i cal livery stable, where It died sev-j sev-j oral days later, its death not beiiiK directly due to its exposure, but to its general broken down condition The proprietor of the livery stab'e presented Officer Iayne with a bill for $15 for the care of the horse-while horse-while it was there. The sergeant, in order to find who was responsible for the bill, swore out a complaint against Barrows. charging cruelty to animals. In extenuation ex-tenuation of his act in leaving the horse tied near the Lee residence. Mr. Barrows stated that he notified the family that the animal was there and said that Leo ahould ha taken care of it. He also said that it had been fed and watered a short time before It was tied up. In summing up the ease, the judge stated that the livery tuablp bill would have to be paid by the man who owned the horse at the time it was in the stable. According to the decision III the civil suit. Lee is responsible for the bill, but as he Is to appeal the case to the supremo court if necessary, he said, it is probable prob-able that the liveryman will have to wait some time for his money The complaint against Mr. Barrows was dismissed. |
