Show WORE ON THE CONDUIT TRENCH All legal obstructions to the building build-ing of the Cold Water Canyon conduit con-duit hnvo been removed aud tho work will bo rushed by Contractor O'N'eill, tho expectation being that It will be completed Juno 1, when an additional supply of puro mountain water will be turned into the reservoirs at the eastern east-ern boundary of tho city. By June 1 the old reservoir will he concreted and be ready for use. The main extending from tho reservoirs to Washington avenue, along Twenty-third Twenty-third street, may be In tho ground and ready for uso at that time, so that simultaneously with the turning of the water Into tho water system from Cold Water Canyon will be opened tho double pipe lino to tho central distributing system of tho city, perfecting per-fecting a double main system from Washington avenue to the month of Cold Water Canyon. Judge Howell this morning issued an order giving Ogden immediate possession pos-session of tho pipe line over tho property prop-erty owned by the Ogden Medicliyil Springs company, tho city having begun be-gun condemnation proceedings to fix the right of way over tho ground. Tho valuation of tho property will bo determined de-termined at soino future time by tho court or a commission appointed for that purpose. This means that the city has cleared the way for the contractor, con-tractor, in so far as thp matter of oc cupancy of the ground Is concerned. Judge Howell also made an order modifying the restraining order heretofore here-tofore enjoining the contracting company com-pany from further operation in tho building of tho trench for tho pipe secured se-cured by the Sanitarium company, the modification providing that the O'Neill Construction company may occupy tho ground for construction purposes, provided, pro-vided, that the blasting that shall bo done shall In no way damage the Sanitarium San-itarium property. Tho question of damages, sued for by tho Sanitarium company will bo settled in the courts, or otherwise at some future time It will be remembered that only a short time ago the Sanitarium company com-pany commenced suit against tho J P O'Neill Construction company for Sl.-000 Sl.-000 damages, alleged to have been done the plaintiff's propertv bv tho defendant while blasting rock on the mountain side This stopped tho work of tho construction company and nothing has been done by way of building the conduit on the ground in quostion since that tlmo until this morning, when Mr O Nelll renewed operations. Most of tho trench has boon dug ovor the property In quostion, there remaining only the completion of certain cer-tain tunnels It has been agreed by the parties that every possible caro shall be exorcised so as to not damage dam-age the Sanitarium property. The court stated this morning that if it becomes necossary for the construction con-struction company to blast rock in such n way as to endanger Uio property prop-erty of tho Sanitarium comnanv, an appearance shall be mado in court and further action taken in tho promises. It appears to bo certain that construction construc-tion work will not bo retarded In tho future The court has ordernd that the contractor con-tractor antl th1 citv shall occupy tho grounds along the line of the conduit in all other cases where relief has beqn sought by condemnation proceedings proceed-ings by the city. Tuc mnjorlty of the material for the conduit has arrived and is being placed plac-ed whore it can bn handled in laying tho pipe. There Is but very little of the trench remaining to bo dug. As time passes, the work will be handled more rapidly, tho men becoming more efficient in tho work b they becomo more familiar with the ground and the clasB of material they have to deal with. oo |
