There is to be no special RESOLUTION NO. 1 A resolution providing for the holding of a special election elec-tion to be held on September 3, 19G8, for the purpose of submitting to the qualified electors of Cedar City, Iron County, Utah, the questions of the issuance of $105,000 of General Obligation Storm Sewer Bonds and $320,000 of General Obligation Water Bonds of said City. SECTION 6. Only qualified electors of Cedar City as shall have paid a property tax therein during the twelve months preceding such election elec-tion shall be permitted to cast a vote at such election. Any person applying for a ballot bal-lot at the polling places designated for the conduct of such election who is not challenged chal-lenged and any such person whose qualifications to vote are challenged by any one or more of the election officials or by any other person at the time the ballot is applied for shall receive a ballot and be entitled to vote If (1) such person is shown on the registration regis-tration lists as a registered voter in Cedar City, and (2) such person (a) signs an oath sworn to before one of the election officials that he is a qualified elector of Cedar City and has paid a property tax therein in the twelve months preceding such election or (b) produces a tax receipt showing show-ing that he owned of record property in Cedar City on which he had paid a property tax during the twelve months preceding the election. elec-tion. In the case of any such challenge or challenges, the election officials shall keep a list of the names of each person per-son challenged, the grounds for such challenge, and whether such person was permitted per-mitted to vote. Such list shall be made in duplicate by the election officials at the polling poll-ing places and after the closing clos-ing of the polls a duplicate list shall be returned to the governing body by the election elec-tion officials so that such duplicate du-plicate list will be available' to the governing body when it canvasses the election results. re-sults. SECTION 7. The County Assessor As-sessor and County Treasurer, or such persons as they may designate, are hereby directed direct-ed to check the registration lists against the, tax rolls "of" Cedar City and indicate, on the registration lists by appropriate ap-propriate mark (a) the names of the electors shown thereon who paid a personal property tax in the City during the twelve months preceding the registration of voters for such election and the official register reg-ister last made or revised shall constitute the register for such election, except that the County Clerk of Iron County will register at his office of-fice during the regular office hours, except Saturdays, Sundays Sun-days and holidays and except during the ten-day period immediately im-mediately preceding the bond election, any person who on the day of the election will be a qualified elector and will register such persons as provided by law. The County Clerk will make available or will cause the registration agents to make available at the above described polling places a registration list or copy thereof listing all registered regis-tered electors entitled to use such voting place. Notice is further given that on Thursday, the 5th day of September, 19G8, that being within ten days after said election, the City Council will meet at its regular meeting place in Cedar City, Utah, at 7:30 o'clock p. m. and canvass the returns and declare the results of said election. That the ballot to be used at the bond election elec-tion shall comply in all respects re-spects with the Utah Municipal Munici-pal Bond Act and shall be in substantially the following form: BALLOT NO PROPOSITION NO. 1 STORM SEWER BONDS Shall the City Council of Cedar City, Utah, be authorized to issue the General Obligation Storm Sewer Bonds of said City Ci-ty in the amount of not to exceed ex-ceed One Hundred Five Thousand Thou-sand Dollars ($105,000), bearing bear-ing interest at a rate or rates not to exceed six percent (6) per annum and due and payable pay-able in not to exceed Thirty (30) years from the date of said bonds; these bonds to be struct drainage and flood control con-trol structures; and to construct con-struct storm sewers and curb and gutter in said City; and WHEREAS, said City does not have on hand money to pay for such construction; '.and the City Council has determined de-termined to defray the cost "thereof through the issuance fof $105,000 General Obligation Obliga-tion Storm Sewer Bonds arid 15320,000 General Obligation Water Bonds; and WHEREAS, it is desired to submit propositions concerning concern-ing the issuance of such bonds to the vote of the qualified, qual-ified, taxpaying electors of Cedar City, pursuant to the provisions of the Utah Municipal Muni-cipal Bond Act. NOW, THEREFORE, Be It -Resolved by the City Council of Cedar City, Iron County, Utah, as follows: SECTION 1. On the 3rd day of September, 1968, there shall "be held in said City a special election between the hours of 7:00 o'clock a. m. and 8:00 o'clock p. m., at which time there shall be submitted to such qualified electors of ; said City as shall have paid a property tax therein during the twelve months preceding such election the propositions in the form of ballot set out in Section 4 hereof. SECTION 2. The voting place for said election and the officials who are hereby appointed to serve at such voting place shall be those pecified In the form of Notice No-tice of Election set out in Section Sec-tion 3 hereof. Said officials are qualified electors of said City. SECTION 3. Notice of such flection shall be published three (3) times, once a week ; during three (3) consecutive weeks, the first publication to I be not less than 21 nor more than 35 days before the election, elec-tion, in the Iron County Rec- j ord, a newspaper of general I circulation in Cedar City, (Utah, and qualified to carry legal notices under the laws of the state of Utah. Such no- itice shall be in substantially the following form: SECTION 9. The City Council Coun-cil hereby provides and directs dir-ects that this resolution be published one time in the Iron County Record, a newspaper news-paper of general circulation in Cedar City, Utah. For a per-iod per-iod of thirty (30) days after such publication, any person in interest shall have the right to contest the legality of this resolution or any action ac-tion taken pursant thereto, but after such time no one shall have any cause of action ac-tion to contest the regularity, formality, or legality thereof for any cause whatsoever. SECTION 10. This resolution shall take effect immediately upon its passage and approval. approv-al.
