Show Jury Vindicates Boulder Man In Alleged Assault Suit PANGUITCH - A jury in Sixth District Court in Panguitch awarded Boulder res ident and former Anasazi State Park manager Larry Davis $162,000 in the assault and battery bat-tery lawsuit filed against him by another Boulder resident Julian Hatch. Davis had countersued, claiming that Hatch had harassed him since 1990 with false allegations to his superiors and in his community. Hatch had . claimed the assault took place at a Boulder Town Council meeting in February 1996. Davis' counter-suit counter-suit alleged Hatch's case had no merit and that Hatch had harassed him for some 12 years. Following several days of testimony by numerous witnesses, witness-es, the jury, after only two hours of deliberation, vindicated Davis. Judge K.L. Mclff awarded award-ed Davis $87,000 for emotional distress and $75,000 for Hatch's abuse of the legal process. . The judge is also taking under consideration con-sideration a possible additional award to Davis for legal expenses expens-es he incurred since 1996 in defending himself against Hatch. Davis was represented by James Bradshaw, Salt Lake City, who said Hatch's case against Davis constituted a personal vendetta. Hatch who was represented repre-sented by Budge W. Call, promised prom-ised the case would be appealed. |
